According to the Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils (amended) that has just been passed, the National Assembly and People's Councils at the provincial and district levels shall organize a vote of confidence once per term at the third year-end session of the term.

On the afternoon of June 23, continuing the 5th Session, the National Assembly voted to pass a Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly or People's Council (amended).

No vote of confidence for those awaiting retirement

After listening to the Chairman of the National Assembly's Law Committee Hoang Thanh Tung present a report explaining, accepting and revising the draft Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly or People's Council (amended), the National Assembly voted to pass this Resolution.

The results showed that 470 National Assembly deputies participated in the vote in favor (accounting for 95.14%). Thus, with the majority of deputies participating in the vote in favor, the National Assembly officially passed the Resolution on taking a vote of confidence, a vote of no confidence for people holding positions elected or approved by the National Assembly and People's Councils (amended).

According to the Resolution, the National Assembly will take a vote of confidence for the following positions: President, Vice President; Chairman of the National Assembly, Vice Chairman of the National Assembly, member of the National Assembly Standing Committee, Secretary General of the National Assembly, Chairman of the Nationality Council, Chairman of the National Assembly Committee; Prime Minister, Deputy Prime Ministers, Ministers, other members of the Government; Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy , State Auditor General.

The People's Councils at provincial and district levels take a vote of confidence for the following positions: Chairman of the People's Council, Vice Chairman of the People's Council, Head of the People's Council Committee at provincial and district levels; Chairman of the People's Committee, Vice Chairman of the People's Committee, members of the People's Committee at provincial and district levels.

The National Assembly and the People's Council shall vote on confidence for the person holding the position elected or approved by the National Assembly or the People's Council in the cases specified in Article 13 of this Resolution. In case a person simultaneously holds multiple positions specified in Clause 1 or Clause 2 of this Article, the vote of confidence shall be conducted once for all such positions.

The Resolution clearly states that no vote of confidence will be taken for those holding positions specified in Clause 1 and Clause 2, Article 13 who have announced their resignation pending retirement or have been appointed or elected in the year of the vote of confidence.

The vote of confidence and the vote of no confidence aim to improve the effectiveness and efficiency of the supervision activities of the National Assembly and the People's Council; improve the quality and efficiency of the state apparatus; contribute to assessing the prestige and performance results of the assigned tasks and powers of the person who is subject to the vote of confidence and the vote of no confidence, helping them see their level of trust to continue to strive, practice, improve the quality and efficiency of work; serve as a basis for competent agencies and organizations to consider planning, training, fostering, arranging and using cadres.

In principle, taking a vote of confidence and casting a vote of no confidence is to ensure the rights and promote the responsibilities of National Assembly deputies and People's Council deputies in taking a vote of confidence and casting a vote of no confidence; and to ensure the right to report and explain of those who are subject to a vote of confidence and casting a vote of no confidence.

At the same time, ensure democracy, objectivity, impartiality, publicity, and transparency; correctly assess the actual performance of tasks, powers, and political qualities, ethics, and lifestyle of those who are voted on for a vote of confidence; ensure the stability and effectiveness of the state apparatus and the Party's leadership in personnel work.

Regarding the time limit and timing of the vote of confidence, the National Assembly and the People's Councils at the provincial and district levels shall organize the vote of confidence once per term at the third year-end session of the term.

Previously, in the report explaining, receiving and revising the draft Resolution of the National Assembly on taking a vote of confidence, voting for confidence in people holding positions elected or approved by the National Assembly and People's Councils (amended), Chairman of the Law Committee Hoang Thanh Tung stated: Regarding the subjects of taking a vote of confidence (Article 2), there was a proposal not to stipulate the taking of a vote of confidence for commune-level officials to ensure consistency with the scope of subjects eligible for a vote of confidence according to Regulation No. 96-QD/TW.

The National Assembly Standing Committee accepted the above opinion and revised Clause 2, Article 2 of the draft Resolution in the direction that the vote of confidence can only be carried out at the People's Councils at the provincial and district levels.

Regarding the non-voting of confidence for people with serious illnesses confirmed by medical facilities and who have not been in charge of work for 6 months or more, after discussion, there were opinions in agreement with the draft Resolution and a proposal to add cases of being absent from work for 6 months or more for other reasons (not for health reasons). On the contrary, some opinions suggested that it is necessary to closely follow Regulation No. 96-QD/TW on cases where a vote of confidence is not taken to ensure strictness and avoid abuse.

The Standing Committee of the National Assembly finds that the vote of confidence is an important monitoring channel of the National Assembly and the People's Council; the results of the vote of confidence are used to evaluate cadres, as a basis for planning, mobilizing, appointing, recommending cadres for election, dismissing and implementing regimes and policies for cadres. Regulation No. 96-QD/TW has specifically identified cases where a vote of confidence is not conducted.

Therefore, absorbing the opinions of National Assembly deputies, the National Assembly Standing Committee has revised the provisions in Clause 5, Article 2 of the draft Resolution in the direction of not taking a vote of confidence for those who have notified of their resignation pending retirement or have been appointed or elected in the year of taking the vote of confidence.

Regarding the consequences of taking a vote of confidence and a vote of no confidence (Article 12, Article 17), there are opinions in agreement with the draft Resolution and that there should be a mechanism for people with low confidence votes to proactively resign, and an additional deadline for resignation... On the contrary, there are also opinions suggesting that a vote of no confidence should always be carried out to ensure seriousness.

The Standing Committee of the National Assembly reported as follows: The provisions in Clauses 2 and 3, Article 12 of the draft Resolution consistently and fully reflect the spirit of Regulation No. 96-QD/TW on the use of confidence vote results and the requirement to strengthen Party building and rectification.

To be consistent with the scope of regulation, the draft Resolution does not specify in detail all cases of handling the consequences of taking a vote of confidence as well as the deadline for the person subject to the vote of confidence to resign, but this content will be implemented according to other relevant regulations of the Party and State.

Regarding the proposal to stipulate that if a person with a vote of confidence has more than half of the total number of votes of "no confidence", the National Assembly and the People's Council can consider dismissing him/her immediately at that session without waiting for the next session, the National Assembly Standing Committee reports as follows: The draft Resolution stipulates that the consideration of dismissal for a person with more than half of the total number of votes of "no confidence" can be carried out at that session or the nearest session to ensure flexibility in implementing personnel procedures.

Such a provision is also consistent with the practical operations of the People's Council at the local level, where the People's Council's sessions often take place in a very short period of time.

On the other hand, Article 19 of the draft Resolution has added provisions on the responsibility to report the results of the vote of confidence and the vote of confidence of the People's Council to the competent authority in charge of cadre management and the direct superior agency for supervision, so issues related to cadre work will be closely monitored and handled as soon as possible, limiting the situation of cadres with low confidence continuing to hold their positions for a long time afterwards.

The Resolution on taking a vote of confidence and voting for confidence in people holding positions elected or approved by the National Assembly or People's Council (amended), consisting of 22 articles and 7 attached appendices, will officially take effect from July 1, 2023.
