Ho Chi Minh City urgently directs to lift suspension of asset transactions related to Vu 'aluminum'

The People's Committee of Ho Chi Minh City issued an urgent document conveying the opinion of Mr. Phan Van Mai - Chairman of the City, directing the Department of Natural Resources and Environment and the Department of Justice to coordinate in implementing the official dispatch of the Ministry of Public Security's Investigation Police Agency on canceling the suspension of asset transactions, ensuring the normal operation of companies related to Mr. Phan Van Anh Vu (aka Vu "aluminum").

Ho Chi Minh City People's Committee requires the implementation time to be 15 days from the date of receipt of the document.

Previously, in early May, the Office of the Criminal Police Department (C01) - Ministry of Public Security sent a document to the People's Committee of Ho Chi Minh City requesting to resolve the above issue.

Specifically, Department C01 said that it is investigating the cases of "Intentionally revealing state secrets", "Tax evasion", "Abusing positions and powers while performing official duties", "Violating regulations on management and use of state assets causing loss and waste" and "Violating regulations on land management", related to Mr. Phan Van Anh Vu that occurred in Da Nang City.

Regarding these cases, to ensure execution of the judgment, C01 has seized assets related to Mr. Vu in Ho Chi Minh City.

Specifically, the seized assets include: land use rights at land plot No. 15 Thi Sach Street, Ben Nghe Ward, District 1 with an area of 2,366m2 of Bac Nam 79 Construction Joint Stock Company, which was granted land use rights by the Ho Chi Minh City People's Committee according to the decision dated June 11, 2015. And land use rights, house ownership rights and other assets attached to land at No. 8 Nguyen Trung Truc Street, Ben Thanh Ward, District 1 with an area of 1,297m2, granted by the Ho Chi Minh City Department of Natural Resources and Environment to Bac Nam 79 Construction Joint Stock Company on May 28, 2012.

In addition, on April 20, 2018, the Ministry of Public Security's Investigation Police Agency issued an official dispatch requesting the Ho Chi Minh City People's Committee to temporarily suspend transactions of assets, including shares, stocks, real estate, property rights... of individuals and organizations related to Mr. Phan Van Anh Vu, including Construction Joint Stock Company 79 and Construction Joint Stock Company Bac Nam 79.

The document of Department C01 said that all cases related to Phan Van Anh Vu were brought to trial and the verdict has come into legal effect.

The judgments only declare to continue to maintain the seizure order for 2 assets, which are land use rights, house ownership rights and other assets attached to the above-mentioned land; do not declare to temporarily suspend property transactions, freeze the bank accounts of Construction Joint Stock Company 79, Construction Joint Stock Company Bac Nam 79, LVC Company Limited, Nhat Gia Phuc Joint Stock Company (all headquartered in Da Nang) to serve the execution of the judgment.

Therefore, the Ministry of Public Security's Investigation Police Agency requested the Ho Chi Minh City People's Committee to direct relevant departments, branches and units to resolve the request of the above companies to cancel the suspension of asset transactions and freeze bank accounts to ensure normal operations, in accordance with legal regulations to ensure the rights and legitimate interests of shareholders and capital contributors.

In addition, the Ministry of Public Security's Investigation Police Agency has a document requesting the Ho Chi Minh City People's Committee to direct relevant units to handle the request of Ms. Nguyen Thi Thu Hien (wife of Mr. Phan Van Anh Vu) to cancel the suspension of property transactions related to her in Ho Chi Minh City.

Recently, Mr. Phan Van Mai - Chairman of Ho Chi Minh City People's Committee has directed 2 relevant departments to solve this problem.

Similarly, also based on the request document of the Ministry of Public Security's Investigation Police Agency, the Chairman of the People's Committee of Da Nang City also directed relevant departments and units to resolve the cancellation of the suspension of asset transactions, ensuring the normal operation of companies related to Mr. Phan Van Anh Vu - including 9 assets of land use rights, house ownership rights and other assets related to Mr. Phan Van Anh Vu that the Ministry of Public Security's Investigation Police Agency had seized while investigating the cases.
