Army generals no more than 415 people, increase retirement age of officers

(Dan Tri) - The total number of generals in the army is at most 415 people, the retirement age of officers is increased by 1-5 years... are important regulations in the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
On the morning of November 28, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army with 458/459 delegates in favor (accounting for 95.62% of the total number of National Assembly delegates). The Law takes effect from December 1. Article 15 of the Law stipulates the highest military rank with the position and title of an officer. Accordingly, the rank of General has no more than 3, including: Minister of National Defense ; Chief of the General Staff and Director of the General Department of Politics. Senior Lieutenant General, Navy Admiral has no more than 14, including: Deputy Minister of National Defense, Navy Admiral (no more than 6 people); Deputy Chief of the General Staff, Deputy Director of the General Department of Politics (each position has the highest military rank of Senior Lieutenant General, no more than 3). The positions and titles with the highest military ranks are Lieutenant General, Vice Admiral of the Navy; Major General, Rear Admiral of the Navy, with a maximum number of 398. Thus, the total number of the highest military ranks is 415 people. Still according to the provisions of the new law, the seconded military officer elected to hold the position of Chairman of the National Defense and Security Committee has the highest military rank of Senior Lieutenant General. The seconded military officer approved to hold the position of Deputy Chairman of the National Defense and Security Committee is appointed to the position of Deputy Minister or equivalent position or title, with the highest military rank of Lieutenant General. The seconded military officer approved to hold the position of Standing Member of the National Defense and Security Committee/ appointed to the position of General Director or equivalent position or title, with the highest military rank of Major General. Chairman of the National Defense and Security Committee Le Tan Toi said that some delegates suggested considering the general rank corresponding to the army and police in large, key provinces and cities; clearly defining the number of generals for each rank. The National Assembly Standing Committee believes that if the number of Senior Lieutenant Generals is added to the position of Deputy Chief of the General Staff and the ceiling of general ranks for the Commanders of the Military Commands of 11 key provinces as in the Law on the People's Public Security, it will not be in accordance with Resolution No. 51 of the Central Committee and will exceed the number of generals as prescribed by the Politburo (415 people). In addition, this will affect the thoughts, aspirations of the Commanders and Political Commissars of the Military Commands and Border Guard Commands of other provinces and cities, not ensuring the principle that the officer ranks of the superior are higher than the officer ranks of the subordinate. The National Assembly Standing Committee said that currently, the Central Military Commission and the Ministry of National Defense are studying and proposing amendments to the decree and circular on positions and titles of military officers. In particular, they will carefully consider and calculate the highest military rank of officers in the entire army, supplement specific regulations on the number and each position with the military rank of Lieutenant General, Vice Admiral of the Navy and Major General, Rear Admiral of the Navy, ensuring strictness, transparency and not exceeding the number according to the conclusion of the Politburo. Regarding the highest age of service in the army (retirement age) for officers according to military rank, the newly passed Law stipulates an increase of 1 to 5 years compared to the current law. Specifically, the retirement age of lieutenant is 50 years old; Major is 52 years old; Lieutenant Colonel is 54 years old; Senior Colonel is 56 years old; Colonel is 58 years old and General is 60 years old. When the army has a need, officers with sufficient political qualities, ethics, capacity, health and volunteering, can have their service age extended for no more than 5 years. In special cases, it can be extended according to the regulations of the Minister of National Defense. According to the explanation of the National Assembly Standing Committee, increasing the retirement age of officers will maintain a team of officers with basic training, courage, qualifications, experience, health in command, management, research, consulting and a number of highly qualified officers to have more time to serve in the army, meeting the requirements of building a modern army. This also ensures that officers basically have enough years of social insurance participation to receive a maximum pension of 75%.
