Attending were: members of the Committee on Science, Technology and Environment; representatives of the Ministry of Science and Technology ; permanent representatives of a number of agencies of the National Assembly and relevant ministries and branches.

According to the Draft Law Report, the 2017 Law on Technology Transfer has created a legal framework for domestic technology transfer activities, technology transfer from foreign countries to Vietnam and technology transfer from Vietnam to foreign countries. However, after nearly a decade of implementation, the Law on Technology Transfer has revealed limitations and inadequacies (such as the regulated technology subjects do not cover new technologies; financial, legal and institutional policies for the transferor and transferee of technology are not comprehensive; lack of policies to encourage and support endogenous technology transfer; weak science and technology market; ineffective state management of technology transfer...), has not kept up with the rapid development of science, technology and innovation in the world; has not met the context of our country facing the requirements of breakthroughs in science, technology development, innovation and digital transformation.
Therefore, it is necessary to amend and supplement a number of articles of the Law on Technology Transfer to continue perfecting the legal framework to promote effective and synchronous technology transfer activities, in accordance with practical requirements and socio -economic development policies, while keeping up with world trends in technology transfer.

Through discussion, delegates basically agreed on the viewpoints, objectives and scope of amendments of the draft Law. The content of the draft Law is consistent with the Party's innovation policies and guidelines; promptly removes difficulties and shortcomings in state management, meets practical requirements and international integration.
The draft Law is submitted according to a simplified order and procedure, the draft Law dossier is seriously prepared, basically ensuring compliance with the requirements specified in Clause 5, Article 51 of the Law on Promulgation of Legal Documents, and is qualified to be submitted to the National Assembly.

Delegates also suggested the need to ensure consistency in the legal system; limit the occurrence of administrative procedures and request the drafting agency to continue reviewing the provisions of the draft Law with relevant laws; and regulations on property rights in technology transfer to ensure comprehensive management of regulations on this content.
Some opinions suggested that the drafting agency continue to review the concepts and terms in the draft Law to ensure high universality; research to more clearly demonstrate in the draft Law the content of technology transfer from Vietnam to foreign countries. Some opinions suggested that the drafting agency consider the chapter on state management, because this is a law amending and supplementing a number of articles of the Law on Technology Transfer, therefore, this content should not be included in the draft Law.

In response to comments at the meeting, Deputy Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan requested the Ministry of Science and Technology to synthesize, research, absorb, explain comments and complete the draft Law before submitting it to the National Assembly for consideration at the upcoming 10th Session.
On behalf of the Standing Committee of the Science, Technology and Environment, delivering the closing speech of the meeting, Vice Chairman of the Science, Technology and Environment Committee Nguyen Phuong Tuan stated that after 2 days of active, urgent, serious and highly responsible work, the Science, Technology and Environment Committee has completed the proposed program, examining 6 contents expected to be submitted to the National Assembly for consideration at the 10th Session, including: the draft Law on amending and supplementing a number of articles of the Law on Geology and Minerals; the draft Law on amending and supplementing a number of articles of 15 laws in the fields of agriculture and environment; the draft Law on Construction (amended); the draft Law on Digital Transformation; the draft Law on High Technology (amended); the draft Law on amending and supplementing a number of articles of the Law on Technology Transfer.
Based on the comments on perfecting the draft laws at the meeting, Vice Chairman of the Committee Nguyen Phuong Tuan stated that the Standing Committee of the Committee will receive and perfect the review reports on 5 draft laws: draft law amending and supplementing a number of articles of the Law on Geology and Minerals; draft law amending and supplementing a number of articles of 15 laws in the fields of agriculture and environment; draft law on construction (amended); draft law on digital transformation; draft law on high technology (amended) to submit to the National Assembly Standing Committee for comments, before submitting to the National Assembly at the next session.
