Arrested CEO for defrauding and embezzling 1 billion VND from selling a project

On June 20, information from the Investigation Police Agency of Quang Ninh Province Police, the unit has just issued a decision to prosecute the case, prosecute the accused, and execute an order to temporarily detain Mr. Nguyen Manh Hai, General Director of Thinh Phat Joint Stock Company, for the crime of fraud and appropriation of property, according to the provisions of Clause 4, Article 174 of the Penal Code.

Previously, on February 22, the Investigation Police Agency of Quang Ninh Province Police received and verified the criminal complaint of Mr. Pham Van Toan (44 years old, residing at No. 8, Thai Binh Street, Tan Binh Ward, Hai Duong City, Hai Duong Province) accusing Nguyen Manh Hai (54 years old) of fraud and appropriation of property, through signing a contract to transfer the right to use land lot No. 09-LK06 belonging to the housing group project in Area 4B, Quang Hanh Ward, Cam Pha City (Quang Ninh).

Afterwards, the Investigation Police Agency of Quang Ninh Province investigated the case and determined that on August 9, 2019, the People's Committee of Quang Ninh Province approved the investment policy for the urban infrastructure construction and business project in Area 4B, Quang Hanh Ward (Cam Pha City) in the form of auctioning land use rights.

Upon learning that Cam Pha City People's Committee was preparing to auction the land use rights for the above project, Nguyen Manh Hai provided false information about Thinh Phat Joint Stock Company, of which Hai is the General Director, having an urban infrastructure construction and business project in Zone 4B, Quang Hanh Ward, Cam Pha City.

After that, Hai sent the price list and project diagram to Mr. Pham Van Toan and signed a land use rights transfer contract with this person on June 5, 2022. It is worth mentioning that the above project does not meet the conditions for commercial exploitation; at the same time, Thinh Phat Joint Stock Company has no rights to this project.

With the above trick, Nguyen Manh Hai defrauded and appropriated 1 billion VND from Mr. Pham Van Toan. The Investigation Police Agency of Quang Ninh Province is expanding the investigation into the case.
