The Ministry of Public Security has just announced the latest draft of the law amending and supplementing a number of articles of the 2017 Law on Security Guards.
This agency proposed adding three positions to the group of security personnel, including the Standing Secretary of the Secretariat, Chief Justice of the Supreme People's Court, and Chief Prosecutor of the Supreme People's Procuracy.

Potential threat to life and health
According to the Ministry of Public Security, the Chief Justice of the Supreme People's Court and the Chief Prosecutor of the Supreme People's Procuracy are the heads of the trial and prosecution agencies.
The specific work of these two positions is directly related to directing and organizing the resolution of cases, incidents, and handling of violations and crimes; therefore, there are potentially dangerous factors and a high risk of being threatened or harmed by bad guys to their health and life.
Not to mention, in the trend of promoting judicial reform and strengthening the fight against crime, the nature of the work of the two above-mentioned positions is increasingly complicated, giving rise to many unpredictable situations that threaten life and health.
In addition, on May 5, 2022, the Politburo issued Conclusion No. 35-KL/TW on the list of leadership positions and equivalent positions of the political system from the Central to the grassroots levels.
The conclusion added a number of high-ranking positions and titles such as Standing Member of the Secretariat, Chief Justice of the Supreme People's Court, and Chief Prosecutor of the Supreme People's Procuracy to the group of high-ranking leadership positions of the Party, State, and Vietnam Fatherland Front .
Reality demands it, but the 2017 Law on Security has not yet stipulated that the three positions of the Standing Secretary of the Secretariat, the Chief Justice of the Supreme People's Court and the Chief Prosecutor of the Supreme People's Procuracy are subjects of security. Therefore, the Ministry of Public Security proposes to supplement as mentioned above.

What does guard mode include?
According to the draft law, the Ministry of Public Security also proposed to amend and supplement a number of contents related to the guard regime for people holding high-ranking positions and titles of the Party, State and the Central Committee of the Vietnam Fatherland Front.
In particular, for the General Secretary, President, Chairman of the National Assembly, and Prime Minister, the security regime includes: being assigned a security officer to protect access, being protected at the residence, being protected at the workplace, and being protected at the place of operation. Along with that, the security and safety of belongings, items, food, drinks, and means of transportation are guaranteed.
In addition, when traveling by car, a police car will be arranged to escort the passengers; when traveling by train, a private car will be arranged; when traveling by plane, a private cabin or plane will be used; when traveling by ship, a private ship with guidance and escort protection will be used.
For former General Secretary, former President, former Chairman of the National Assembly, former Prime Minister, the security regime includes: being assigned a security officer to protect access and having their residence protected.
For the Standing Secretariat and Politburo members, the security regime includes: being assigned a security officer to protect access, having their residence protected, having their workplace protected, and when traveling domestically by car, being assigned a police car to guide them if necessary.
For the Party Central Committee Secretary, Chairman of the Central Committee of the Vietnam Fatherland Front, Chief Justice of the Supreme People's Court, Chief Prosecutor of the Supreme People's Procuracy, Vice President, Vice Chairman of the National Assembly, Deputy Prime Minister, the security regime includes: being assigned a security officer to protect access, when traveling domestically by car on business trips, being assigned a police car to escort the way if necessary.
Additional authority where necessary
The Ministry of Public Security said that from July 2018 to now, at the request of ministries, departments and branches, the security force has been deploying a total of 56 security groups for subjects not subject to security as prescribed in the 2017 Security Law.
Based on the above reality, the Ministry of Public Security proposes to supplement the authority of the Minister of Public Security to decide on applying security measures in urgent cases for subjects who are not legally protected subjects, in order to protect national security, social order and safety and foreign affairs of the Party and State.
