Directing the handling of many issues related to the Gem Sky world project

Dong Nai Provincial People's Committee requested the Department of Natural Resources and Environment to urgently review and consider handling the determination of conditions for transferring land use rights for the Gem Sky World project according to its authority.

According to the People's Committee of Dong Nai province, after reviewing Document No. 7982/STN&MT-QH dated October 2, 2023 of the Department of Natural Resources and Environment of Dong Nai reporting the results of receiving citizens and inspecting the current status of land use and constructed works at the Gem Sky World project, the People's Committee of Dong Nai province commented: Regarding the content of handling the conditions for transferring land use rights (LURs), in Section 3, Conclusion Notice No. 377/TB-UBND dated September 8, 2023, the People's Committee of Dong Nai province assigned the Department of Natural Resources and Environment to preside over and organize the inspection of the current status and acceptance records of construction of technical infrastructure and social infrastructure for the area that has been recognized by the People's Committee of Dong Nai province as the winning result of the LUR auction, determining the feasibility of the project investor's commitment progress, on that basis, consider handling the conditions for transferring LURs according to the authority prescribed in Decree No. 148/2020/ND-CP dated September 8, 2023. August 18, 2020 of the Government .

Official dispatch No. 10562/UBND-KTN of the People's Committee of Dong Nai province also stated: Through the inspection report of the Department of Natural Resources and Environment of Dong Nai on the construction and acceptance of technical infrastructure and social infrastructure at the Gem Sky World project invested by Ha An Real Estate Investment and Trading Joint Stock Company, the People's Committee of Dong Nai province agrees with the proposal of the Department of Natural Resources and Environment of Dong Nai, at the same time, requests the Department of Natural Resources and Environment to urgently review and consider handling the determination of conditions for transferring land use rights according to its authority, not to prolong and not to create hot spots, causing loss of security and order in the locality.

According to this Official Dispatch No. 10562, the People's Committee of Dong Nai province also requested Ha An Real Estate Investment and Trading Joint Stock Company to have a written commitment on the progress of implementation, time to complete procedures to invest in completing the Kindergarten at land plot TH-01, Kindergarten at land plot TH-04, Medical Station at land plot YT-01 and legal procedures on fire prevention and fighting, report to the People's Committee of Dong Nai province, and send to the Department of Natural Resources and Environment, Department of Construction before October 20, 2023; organize work, explain, and mobilize customers to not continue to complain about the above 3 social infrastructure works and have a written commitment not to conduct transactions for the remaining land plots until the entire social infrastructure system of the Gem Sky World project is completed.

In Document No. 7982/STN&MT-QH dated October 2, 2023, the Department of Natural Resources and Environment of Dong Nai reported to the Provincial People's Committee: Regarding the conditions for transferring land use rights of the Gem Sky World project, the investor and partners have signed consulting contracts and deposit contracts for 2,305/4,032 land plots. Currently, many cases of complaints are complicated because the land use rights transfer contract has not been signed and the land use rights certificate has not been granted. Thereby, the Department of Natural Resources and Environment proposed that the People's Committee of Dong Nai province consider approving the Department of Natural Resources and Environment to issue a notice of eligibility for transfer of 2,305 land plots when the investor has been appraised and accepted by competent authorities for wastewater treatment works and is granted an environmental license. Particularly for the construction of 2 kindergartens and 1 medical station above, it is recommended that the investor commit to completing the investment in 2023.

Dong Nai Department of Natural Resources and Environment requested Ha An Real Estate Investment and Trading Joint Stock Company to send a document to households committing to the progress of handing over land and townhouses of the Gem Sky World project.

On October 5, 2023, the Department of Natural Resources and Environment of Dong Nai province issued Official Dispatch No. 8107/STNMT-TT to Ha An Real Estate Investment and Trading Joint Stock Company (investor) and Dat Xanh Real Estate Services Joint Stock Company (service consultant) regarding the handling of the Gem Sky World project. In this Official Dispatch No. 8107, it is stated that: The content of the citizen's petition at the meeting on September 14, 2023, requested Ha An Real Estate Investment and Trading Joint Stock Company to specifically commit to the time and progress of handing over land plots and townhouses for the Gem Sky World project and requested Dat Xanh Real Estate Services Joint Stock Company to work with the bank to resolve issues related to loans, resolve bad debt issues and pay off all loans to the bank.

Based on the above reflections of the people, the Department of Natural Resources and Environment of Dong Nai requested Ha An Real Estate Investment and Trading Joint Stock Company to send specific documents to households on the content of the commitment to the progress of handing over land and townhouses of the Gem Sky World project. The implementation results must be before October 10, 2023. At the same time, the Department of Natural Resources and Environment of Dong Nai also requested Dat Xanh Real Estate Services Joint Stock Company to coordinate with Ha An Real Estate Investment and Trading Joint Stock Company to work with the bank to review and classify customers and bank debt groups, thereby having a plan to completely handle issues related to bank debt of people at the Gem Sky World project and specifically notify the people in writing. The implementation results must be in October 2023. The Department of Natural Resources and Environment of Dong Nai also requested Ha An Real Estate Investment and Trading Joint Stock Company and Dat Xanh Real Estate Services Joint Stock Company to urgently implement and report the results to the Department of Natural Resources and Environment for monitoring.
