The project is implemented in Dai Duc and Tam Ky communes, Kim Thanh district, Hai Duong province with an area of ​​234.63 hectares.

Deputy Prime Minister Tran Hong Ha has just signed Decision No. 211/QD-TTg dated January 22, 2025 on the investment policy for the project to invest in construction and business of infrastructure of Kim Thanh 2 Industrial Park (phase 1), Hai Duong province.

Investment capital 3,403 billion VND

Accordingly, the Deputy Prime Minister approved the investment policy for construction and business of infrastructure of Kim Thanh 2 Industrial Park (phase 1), and at the same time approved the investor Hung Yen Investment and Development Group Joint Stock Company.

The project is implemented in Dai Duc commune and Tam Ky commune, Kim Thanh district, Hai Duong province with an area of ​​234.63 hectares (including the river area of ​​18.68 hectares kept in its original state).

Project investment capital: 3,403 billion VND, of which investor's contributed capital is 513.85 billion VND.

Project duration: 50 years from the date of investment policy approval.

The Deputy Prime Minister assigned the Ministry of Planning and Investment to be responsible for the assigned contents of project investment policy appraisal and to perform state management of industrial parks in accordance with the provisions of the law on investment and relevant laws.

The relevant Ministries are responsible for the content of project investment policy appraisal within their functions and duties according to the provisions of the law on investment and relevant laws.

Ensure there are no disputes or complaints regarding the right to use the project site.

The People's Committee of Hai Duong province ensures that the project is included in the land allocation and zoning plan in the Hai Duong Provincial Planning for the period of 2021-2030, with a vision to 2050, approved by competent authorities in accordance with the provisions of the law on planning and land law; is allocated enough industrial park land to implement according to the approved schedule; is responsible for inspecting and supervising the Investor during the project implementation process; ensures that the project implementation location is consistent with the location determined in the construction planning of Kim Thanh 2 Industrial Park (phase 1) and the planning of Hai Duong province, consistent with the national master plan, national sectoral plans, regional plans and planning of Hai Duong province approved by competent authorities; reviews the project boundaries to ensure compliance with the provisions of the law on traffic, the law on irrigation, the law on water resources.

The People's Committee of Hai Duong province is responsible for reviewing the land area of ​​rivers, ditches, canals and streams within the scope of the Project implementation as determined in the approved construction zoning plan to ensure that the investment and construction plan and the conversion of land use purposes for the Project implementation comply with the provisions of Clause 5, Article 8 of the Law on Water Resources, other relevant regulations and supervise investors in compliance with the provisions of law. In case of violations, the People's Committee of Hai Duong province is requested to preside over and handle them in accordance with the provisions of law.

In addition, the People's Committee of Hai Duong province shall organize the development and implementation of plans for land recovery, compensation, resettlement support, conversion of land use purposes, and land lease to implement projects in accordance with documents approved by competent authorities on area scale, location, and project implementation progress; ensure that there are no disputes or complaints regarding the right to use the project site; supplement the lost area of ​​land for rice cultivation or increase the efficiency of rice land use according to the provisions of Point b, Clause 4, Article 182 of the Land Law.

Take full responsibility before the Government and the law for the conversion of the purpose of using rice-growing land and other types of agricultural land in the Project implementation area according to the provisions of the law on land and regulations on management and use of rice-growing land.

Keep the river area intact, do not encroach or fill the river.

Hung Yen Investment and Development Group Joint Stock Company (investor) is responsible before the law for the legality, accuracy and honesty of the contents of the project dossier and documents sent to competent state agencies; complies with the provisions of law in implementing the project according to this Decision; invests in the construction of the infrastructure system according to the construction planning of Kim Thanh 2 Industrial Park (phase 1) approved by competent authorities; maintains the status quo of the river area, does not encroach or fill the river, strictly complies with the provisions of the Law on Water Resources; bears all risks, costs and takes full responsibility according to the provisions of Article 47 and Article 48 of the Investment Law in case of violating the provisions of the law on investment, the law on land and the law on industrial parks.

Use equity capital to implement the project in accordance with the commitment and have a plan to recover short-term receivables to implement the project. The investor is responsible for mobilizing other capital sources to implement the Kim Thanh 2 industrial park project (phase 1) when it is unable to mobilize enough expected capital from credit institutions; comply with the provisions of the law on investment, the law on land, the law on real estate business and other relevant legal provisions; fully meet the conditions for organizations when doing real estate business as prescribed in Point b, Point c, Clause 2, Article 9 of the Law on Real Estate Business and Clause 1, Article 5 of Decree No. 96/2024/ND-CP when doing business in industrial park infrastructure.

Fully implement environmental protection procedures in accordance with the provisions of law and comply with the provisions of law on water resources.

Deposit or have a bank guarantee on deposit obligation to ensure project implementation; have a plan to recover short-term receivables for individuals borrowing to implement the Project...
