Fees for certification of origin of goods (C/O); Forms of testing and evaluation of multi-level marketing legal knowledge test results; ... are prominent new policies that will take effect from the end of July 2023 (from July 21 to 31, 2023).

Outstanding new policies effective from July 21-31, 2023.

1. Maximum fine for administrative violations in cultivation

The content mentioned in Decree 31/2023/ND-CP stipulates administrative sanctions for violations in Cultivation, effective from July 28, 2023.

Accordingly, the maximum fine for an administrative violation of crop cultivation (except fertilizer) for an individual is 50,000,000 VND.

The maximum fine for an administrative violation of fertilizer for an individual is 100,000,000 VND.

The fines prescribed in Chapter II and Chapter III of Decree 31/2023/ND-CP are fines applied to individuals.

The fine for an organization committing the same administrative violation is twice the fine for an individual.

The statute of limitations for administrative sanctions for violations of cultivation is 01 year. The statute of limitations for administrative sanctions is 02 years in the following cases:

- Administrative violations of plant variety rights protection.

- Administrative violations in production, trade, export and import of plant varieties.

- Administrative violations in production, trade, export and import of fertilizers.

2. Form of testing and evaluation of multi-level marketing legal knowledge test results

The amended content in Circular 12/2023/TT-BCT amends Circular 10/2018/TT-BCT guiding Decree 40/2018/ND-CP on management of multi-level marketing business activities issued by the Minister of Industry and Trade , effective from July 21, 2023.

Accordingly, the form of testing and evaluating the results of testing knowledge of multi-level sales law includes:

- The test on legal knowledge on multi-level marketing and knowledge for local contacts is conducted in essay or multiple choice form within a minimum time of 60 minutes.

- Test scores are graded on a 100-point scale, with specific requirements as follows:

+ For the test on legal knowledge on multi-level marketing, a test score below 80 points for multiple-choice format or below 65 points for essay format is considered unsatisfactory.

+ For the knowledge test for local focal points, a test score below 70 points for multiple choice format or below 50 points for essay format is considered unsatisfactory.

(Meanwhile, Circular 10/2018/TT-BCT stipulates:

+ The test on legal knowledge on multi-level marketing is conducted in essay or multiple choice form within a minimum time of 60 minutes.

+ Test scores are graded on a 100-point scale. A score below 90 points for multiple-choice tests and below 75 points for essay tests is considered unsatisfactory.)

3. Fees for certification of origin of goods (C/O)

Circular 36/2023/TT-BTC regulating the collection rates, collection, payment, management and use of fees for certificates of origin (C/O) issued by the Minister of Finance , effective from July 21, 2023.

Accordingly, the fee for certification of origin of goods (C/O) is prescribed as follows:

- In case of issuing certificate of origin of goods: 60,000 VND/set of C/O.

- In case of re-issuing certificate of origin: 30,000 VND/set of C/O.

The person paying the fee for certification of origin of goods (C/O) is the trader requesting the issuance of a certificate of origin of goods as prescribed in Clause 17, Article 3 of Decree 31/2018/ND-CP, with a dossier requesting the competent agency or organization to issue a certificate of origin of goods.
