Conditions for early retirement when health declines

Vietnam Social Security said that not everyone with reduced working capacity can retire early, only some cases that meet the conditions can receive pension.

Reader DM sent a question to Vietnam Social Security: "My mother was born in 1975, has paid social insurance for 23 years, of which 12 years were spent as a direct petrol sales employee at a private enterprise. Now my mother wants to retire early due to health reasons, please tell me what are the procedures?"

Workers can retire early if their working capacity is reduced according to regulations.

Vietnam Social Security replies: According to Clause 1, Article 65 of the 2024 Law on Social Insurance, employees who have paid compulsory social insurance for 20 years or more, if their working capacity is reduced, will receive a pension at an age lower than the normal retirement age, in some cases:

Less than 5 years of age and impairment from 61% to less than 81%; less than 10 years of age and impairment from 81% or more.

Having worked for at least 15 years in a particularly arduous, toxic, or dangerous job according to the list of the Ministry of Labor, War Invalids, and Social Affairs and having a disability of 61% or more.

The application for pension due to reduced working capacity includes: social insurance book; document terminating labor or employment contract; record of assessment of reduced working capacity by the Medical Assessment Council (or certificate of severe or especially severe disability with conclusion of the Assessment Council).

It is the employer's responsibility to refer the employee for a medical assessment to determine the level of impairment.

According to Article 79 of the 2024 Law on Social Insurance, within 20 days before the date of eligibility for pension, the employer must submit the application to the Social Insurance agency. After receiving the complete application, within 20 working days, the Social Insurance agency must process it; in case of refusal, it must respond in writing and state the reason.
