Using an air gun to shoot down an opponent to stop a fight in Hanoi

Today (June 19), the Hanoi People's Court sentenced defendant Pham Van Truong (born 2000) to 17 years in prison for murder and Vu Van Nguyen (born 1986, both in Hanoi) to 30 months in prison for disturbing public order.

At court, the victim, Mr. Dinh Van Khuong (born 1981, in My Duc district) requested the defendant to compensate 3 billion VND, of which 1 billion VND is compensation for mental damage.

After consideration, the panel ordered the defendant to compensate the victim with 306 million VND in hospital fees and 74 million VND in mental damages. In addition, the defendant was ordered to provide for the children and Mr. Khuong's mother.

According to the accusation, at around 3:00 p.m. on December 5, 2021, during a friendly football match between the two football teams of Tho village and Dong Chiem village (An Phu commune, My Duc district), a collision occurred. The two sides exchanged words and challenged each other.

Mr. Nguyen Hoang Thanh, from Tho village's football team, said: "Be careful not to lose your way home." Mr. Bang, from Dong Chiem village's football team, replied: "Call whoever you can."

Then, Thanh went out and called Vu Van Nguyen (born 1986), Thanh's uncle, and said: "Someone beat you up. Come down near your house."

At that time, Thanh was shooting birds with defendant Pham Van Truong, so he invited him to go with him. When Nguyen and Truong went to Tho village, they met Thanh's group. Dinh Van Khuong (the manager of the soccer field) came out and said: "If you guys fight, I'll call the police." Nguyen cursed back at Khuong, so the two sides argued.

During the scuffle between Mr. Khuong and Nguyen, Truong stood on the side of the road, 7-8 meters away, and fired an air gun at Mr. Khuong. Mr. Nguyen raised his hand and shouted: "Don't shoot, don't shoot", but Truong continued to shoot 2 more times before stopping.

As a result, Mr. Khuong was hit by two bullets, one in the right thigh and one in the left abdomen, and collapsed. Mr. Nguyen himself was also hit by a bullet in the right thigh. After committing the crime, Truong hid the gun in an abandoned house in the commune and fled.

On June 14, 2022, Truong turned himself in to the police and confessed to his crime. The defendant said that he shot Mr. Khuong to prevent the victim from hitting Nguyen.

As for the two victims, after being shot, they were taken to the 103 Military Hospital for emergency treatment. The examination results showed that Mr. Khuong's health damage rate was 96%, both legs were completely paralyzed (87%), part of his spleen was removed, part of his left pleural cavity was damaged... Vu Van Nguyen's health damage was 2%.

Because Nguyen did not discuss or agree with Truong to beat and shoot Mr. Khuong; Nguyen also prevented Truong from raising his gun to shoot, the investigation agency determined that the defendant was not an accomplice with Truong in the crime of murder.

But the defendant went to the soccer field to fight, used concrete debris to hit Mr. Khuong, disrupted public order, and was the direct cause of the shooting of Mr. Khuong at Truong. Therefore, the defendant was prosecuted and tried for the crime of disturbing public order.

During the investigation, the defendant Truong's family compensated Mr. Khuong 100 million VND.

At court, Mr. Khuong asked the panel of judges to sentence the defendant to a severe sentence and said that there was a crime being let go, requesting to clarify the role of Mr. Nguyen Hoang Thanh.
