The principal disciplined and forced the accountant to quit his job against regulations.

(NLDO) - The principal of an elementary school in Gia Lai signed decisions to temporarily suspend and discipline the school's accountants, violating regulations.

On March 8, the People's Committee of Duc Co district, Gia Lai province, is considering handling the responsibility of Mr. Hoang Anh Long, Principal of Tran Phu Primary School (Ia Dom commune), for violations in disciplining Ms. Truong Thi Thuy, an accountant at this school.

On August 30, 2024, Mr. Hoang Anh Long signed Decision No. 01/QD-TP to temporarily suspend Ms. Thuy from work, from August 31 to September 30. On October 10, 2024, Mr. Long continued to sign Decision No. 23/QD-TP to discipline and force Ms. Thuy to quit her job.

After Ms. Thuy filed a petition, Duc Co District People's Committee stepped in to inspect and determined that Mr. Hoang Anh Long's signing of the above two decisions were both against regulations.

The principal of Tran Phu Primary School in Duc Co district signed decisions to suspend and fire accountants in violation of regulations.

In particular, Decision No. 01/QD-TP suspending Ms. Thuy for a period of 31 days is not in accordance with the provisions of Clause 1, Article 54 of the Law on Civil Servants. According to regulations, the head of a public service unit can only decide to temporarily suspend her from work for no more than 15 days, and if necessary, can extend the suspension period but not more than 30 days.

Duc Co District People's Committee is the unit that receives and assigns work to Ms. Thuy according to Decision No. 2155/QD-UBND dated December 31, 2012. Therefore, Mr. Long's decision to force Ms. Thuy to quit her job without reporting to Duc Co District People's Committee (the unit that recruited Ms. Thuy) is not in accordance with the provisions of Point 2, Clause 15, Article 1 of Decree 71/2023/ND-CP of the Government .

In addition, the People's Committee of Duc Co district found that the Disciplinary Council of Tran Phu Primary School and the school principal applied Clause 2, Article 19 of Decree 112/2020/ND-CP of the Government to Ms. Thuy's violations, including: Evading assigned responsibilities, violating regulations on working time, lack of awareness of organizing discipline affecting the organization, to put it at a particularly serious level for disciplinary action in the form of forced dismissal, which is not enough basis.

Faced with the above violations, the People's Committee of Duc Co district requested Mr. Long to issue a decision to partially adjust the decision to temporarily suspend Ms. Thuy from work, and at the same time pay Ms. Thuy full salary according to regulations.

In addition, the District People's Committee also requested Mr. Long to cancel the disciplinary decision to force Ms. Thuy to quit her job in order to review and handle the civil servant's disciplinary action in accordance with regulations. Along with that, Mr. Long will have to restore Ms. Thuy's legal rights and interests in accordance with the law.

On March 3, Mr. Hoang Anh Long signed Decision No. 29/QD-TP on canceling Decision No. 23/QD-TP dated October 10, 2024.
