Currently, according to the provisions of Decree 100/2019/ND-CP and amendments to Decree 123/2021/ND-CP, motorcyclists (including technology motorbike taxi drivers) who use mobile phones will be fined from 800,000 to 1,000,000 VND. In addition, drivers can have their driving license revoked for 1 to 3 months and even 2 to 4 months if the violation leads to a traffic accident.
However, with the rapid development of technology and changes in traffic patterns, the law is considering adjusting some regulations to suit current reality. In particular, a notable new point is the proposal to relax regulations on the use of mobile phones for motorcyclists.
Proposal not to fine motorbike taxi drivers who look up maps on mobile phones
According to the draft new Decree on administrative penalties for road traffic violations, motorcyclists will only be fined if they "hold and use their phones" while driving. This means that if the driver only uses the phone to look up maps through hands-free methods such as using a phone holder or headphones, they will not be fined.
In addition, the penalty for violations has also changed. Instead of having their driver's license revoked as currently regulated, violators will only have 2 points deducted from their driver's license. This helps to reduce the penalty and facilitate drivers who regularly use technology devices such as motorbike taxis, making it easier for them to find their way.
This proposal is expected to receive support from the community of motorbike taxi drivers, who rely heavily on technology to complete their daily work. At the same time, the new regulation still ensures traffic safety, because only cases of "using hands and using phones" will be fined, in order to minimize the situation of losing concentration while driving.
