Some violating wharves in Nam Sach district have been fined and had their operating licenses revoked.

Resolute handling

At the end of May, the Standing Committee of Hai Duong Provincial Party Committee issued a notice concluding the progress and results of handling violations of irrigation works in the province. In particular, Nam Sach is one of two districts required to seriously review and learn from experience in the slow implementation of handling violations within the scope of protection of irrigation works in the field.

Then, in just 3 months, with the determination in leadership and direction, the handling of violations of irrigation works and violations of riverside wharves in Nam Sach district achieved positive results.

In the whole Nam Sach district, there are 27 organizations and individuals operating wharves. Of these, 7 enterprises and individual business households have full legal procedures and have been licensed by the Provincial People's Committee; 12 organizations and individuals have not yet had their investment policy decided by the Provincial or District People's Committee and have not been leased land. The remaining cases have had their investment policy decided by the Provincial or District People's Committee but have not been leased land or have been leased land but their operating licenses have expired. The Nam Sach District People's Committee has issued 6 decisions on administrative sanctions in the fields of investment and dikes.

After checking, there was only one wharf that did not comply with the planning in Nam Tan commune. The business owner voluntarily dismantled the construction on the wharf and terminated the contract. For 26 wharfs and yards that complied with the planning, the cases of construction violations and sheds were dismantled (over 1,500 m2 of construction and sheds were dismantled), and the wharfs that did not have enough administrative procedures had to be completed. The People's Committee of Nam Sach district directed to strengthen the urging and guidance of organizations and individuals to complete legal procedures and resolutely clear the wharf if the wharf owners did not voluntarily complete the application for a license before December 31.

During the flood season, the People's Committee of Nam Sach district requested to close the La dike (Hiep Cat commune) and Co Phap dike (Cong Hoa commune) in combination with preventing illegal activities of wharves, setting up barriers at the top of the dike slope of the wharves, and requiring all The docks will be closed until the end of October.

Party Secretary and Chairman of Nam Hung Commune People's Committee Mac Van Hung said that he promptly handled the situation when people built a 30-ton bridge across the upstream canal.

By August 31, all 273 cases of violations of irrigation works in Nam Sach district had been handled 4 months earlier than the province's request (before December 31). Of the 193 violations before July 1, 2018, 6 cases that had to be cleared have been completed; the remaining 187 cases were specifically identified and recorded, allowing continued use but not expansion or structural changes (implemented according to the Law on Irrigation). 79 violations after July 1, 2018 and 1 violation arising in 2024 have been cleared.

Attention to propaganda and mobilization

The positive changes in the handling of violations and illegal wharfing of irrigation works in Nam Sach come from the determination of the Party Committee and authorities from district to commune.

According to the Head of the Department of Agriculture and Rural Development of Nam Sach district, Mac Van Tuan, the district assigned specific tasks and requested communes, towns, and specialized agencies to thoroughly take action. The head of the local government is responsible to the Chairman of the District People's Committee for handling violations of wharves and irrigation works. The leaders of the District People's Committee and specialized departments directly direct and guide the locality in handling the cases.

"The district's determination and thoroughness in taking action has created a ripple effect and also pressure to help resolve violations of wharves and irrigation works in communes quickly. Party members who violate the law must also be dealt with, and must be dealt with from the beginning to set an example," affirmed Party Secretary and Chairman of Nam Hung Commune People's Committee Mac Van Hung.

The temporary shed of more than 200 square meters in area exceeding the planning at the wharf of Nguyen Thi Lien business household in Thanh Quang commune has been dismantled.

In Nam Hung commune, Mr. Mac Van Luan (Tran Xa village) plans to build a bridge worth nearly 400 million VND connecting the inner-field road to the livestock area, with a load capacity of up to 30 tons. As soon as he discovered that people were constructing a large-scale project, the Chairman of the Commune People's Committee reported to the leaders of the District People's Committee and the Department of Agriculture and Rural Development to directly instruct on how to handle the situation while people were leveling and pouring the bridge abutments. This household voluntarily stopped construction and restored the flow to its original state.

The positive results that Nam Sach achieved in handling violations of wharves and irrigation works are also due to the consensus, change in perspective, and voluntary cooperation of households and businesses with violating works.

In Thanh Quang commune, there are 6 households and businesses operating wharves along Kinh Thay river. At the end of 2023, all 6 of these businesses were licensed to operate but still violated regulations such as building temporary shelters beyond the planning, gathering materials in the flood escape corridor...

Identifying that managing the activities and handling violations of riverside wharves is not easy, Mr. Nguyen Xuan Thao, Party Secretary and Chairman of Thanh Quang Commune People's Committee, pays special attention to propaganda and mobilization for wharves owners. Wharves in Thanh Quang Commune include people from other districts, Mr. Thao maintains close contact with them right from the time they start doing business in the area. When violations are detected, he focuses on propaganda and mobilization of wharves owners, creating favorable conditions and time for them to move materials and dismantle illegal constructions. Serious violations are strictly handled according to instructions and regulations to create deterrence.

Propaganda and mobilization are also the experiences of many communes in Nam Sach in handling violations of irrigation works and wharves. In particular, the role of associations and unions is very important. Thanks to that, people are aware of violations of the law and coordinate to overcome the consequences, prevent recurrence and new violations.
