The Law on the Capital (amended) stipulates additional income for civil servants and public employees.

Regulations on recruitment, management and use of staff

One of the important new points of the Law on the Capital (amended) recently passed by the 15th National Assembly at the 7th Session is the regulation on recruitment, management and use of cadres, civil servants and public employees in Article 15. Accordingly, cadres and civil servants working in communes, wards and towns are cadres and civil servants according to the provisions of the Law on Cadres and Civil Servants under the administrative payroll assigned annually to the district level, elected, recruited, managed and used according to the provisions of the law on cadres and civil servants.

According to the Capital Law (amended), cadres, civil servants and public employees of the Capital are entitled to an income increase of 0.8 times the basic salary fund.

The heads of specialized agencies and other administrative organizations under the City People's Committee and the Chairmen of the District People's Committees are allowed to sign term contracts with people who meet professional and technical requirements to take on certain job positions in specialized and shared professional groups in specialized agencies and other administrative organizations under the City People's Committee and the District People's Committees.

Cadres, civil servants and public employees working in state agencies, political organizations, the Vietnam Fatherland Front, socio-political organizations and public service units whose regular expenditures are fully guaranteed by the state budget under the city's management are entitled to additional income based on their capacity and work efficiency.

Total expenditure does not exceed 0.8 times the basic salary fund.

Notably, the Law on the Capital (amended) was passed, stipulating that the City People's Council decides to use the remaining salary reform funds after ensuring sufficient funds to implement salary reform for the entire period of budget stabilization according to regulations of competent authorities and ensuring social policies, social security, and social welfare issued by the Central Government to implement additional income expenditure for cadres, civil servants, and public employees according to regulations in Clause 3, Article 15 of this Law; the total expenditure level does not exceed 0.8 times the basic salary fund of cadres, civil servants, and public employees under the city's management.

 

On the morning of June 28, the National Assembly voted to pass the Capital Law (amended) with a very high consensus rate.

The Law on the Capital (amended) was approved, consisting of 7 chapters and 54 articles, ensuring full and timely institutionalization of the policies, directions and conclusions of the Central Committee and the Politburo on the construction, development, management and protection of the Capital; closely following the 9 groups of policies decided by the National Assembly when adding the Law project to the Law and Ordinance Building Program.

The City People's Council has the authority to decide on the use of the remaining salary reform fund of the city budget and allow lower-level budgets to use the remaining salary reform fund to invest in developing socio-economic infrastructure under the expenditure tasks of local budget levels, to implement additional income expenditure for cadres, civil servants, and public employees under the city's management and social policies, social security, and social welfare after ensuring sufficient resources to implement salary reform for the entire period of budget stabilization;

Commune-level cadres and civil servants elected or recruited before the effective date of this Law shall be converted into cadres and civil servants according to the provisions of the Law on Cadres and Civil Servants under the administrative payroll assigned annually to the district level to continue working in their current positions; in case of transfer to a new job position, the standards and conditions prescribed by law must be ensured and consistent with the job position approved by the competent authority.

Specific regulations on attracting and employing talented people

The amended Law on the Capital also provides specific regulations on attracting and employing talented people and developing high-quality human resources. Specifically, Article 16 stipulates that attracting and employing talented people is carried out as follows:

Vietnamese citizens with outstanding moral qualities, qualifications, abilities, and practical experience, working domestically or abroad with special works, products, achievements, merits, or contributions to the development of a field or industry of the Capital are eligible to be considered for recruitment and employment as civil servants or public employees.

Vietnamese citizens who meet the criteria specified in Point a of this Clause are allowed to sign contracts to perform professional or technical work or to hold management and executive positions at public service units under the management of the City.

Foreigners with high professional qualifications, extensive practical experience, and whose works or products have been accepted, recognized, and applied with high efficiency will be allowed to sign contracts to carry out the tasks of building, developing, managing, and protecting the Capital.

Those who are selected, accepted or have their employment contract signed as prescribed in points a, b and c of this clause shall enjoy the regimes and policies prescribed by the City People's Council.
