The "scandal" over the Hoa Xuan Wastewater Collection System project has not ended yet.

The construction and installation package of the Wastewater Collection System project in Hoa Xuan area, Cam Le district ( Da Nang ) worth 358 billion VND has just been announced by the Management Board of Investment and Construction of Traffic Works in Da Nang with the result of selecting the contractor on August 2.

The winning bidder is the joint venture of Dacinco Construction Investment Company Limited - Construction Joint Stock Company No. 5 - Hanoi Water Works Construction Joint Stock Company - Nhat Huy Construction and Trading Company Limited. The winning bid price is 358.426 billion VND (estimated price 370.656 billion VND, saving rate 3.3%); contract implementation time is 979 days.

The two consortiums that failed to win this bid are: Consortium of Bach Dang Construction Corporation - JSC, Construction Corporation No. 1 - JSC (BDCC-CC1 Consortium) and Consortium of SEEN Engineering Joint Stock Company, Vietnam Water and Environment Investment Corporation - JSC (MFW Consortium).

Of which, the joint venture of Bach Dang Construction Corporation - Construction Corporation No. 1 had the lowest bid price among the 3 contractors submitting the bidding documents (bidding documents) of 322,607 billion VND, equal to 87.05% of the estimated price.

After the announcement of the bidding results, there were continuous petitions from contractors who participated in the bidding but failed.

Specifically, on August 5, in Official Dispatch No. 140 of BDCC-CC1 Joint Venture sent to the Department of Planning and Investment of Da Nang, the Management Board of Investment Projects for Construction of Traffic Works of Da Nang regarding the results of E-HSDT evaluation and the results of contractor selection.

The BDCC-CC1 consortium disagrees with the evaluation results in the E-HSDT Evaluation Report dated August 1 by the bid evaluation expert team of the Danang Traffic Construction Investment Project Management Board.

“In section 4 of the technical evaluation results, the Expert Group believes that the E-HSDT technical proposal of the BDCC-CC1 Joint Venture does not meet the requirements. The expert group's evaluation explanations are inaccurate and do not comply with the current legal guidance on bid evaluation. The evaluation results of the bid evaluation expert group are highly subjective with the intention of eliminating the E-HSDT of the BDCC-CC1 Joint Venture” - Official Dispatch No. 140 stated.

In the dispatch, the BDCC-CC1 Joint Venture requested the Management Board of the Danang Traffic Construction Investment Project to withdraw Decision No. 257 Approving the results of the contractor selection for the construction package of the Hoa Xuan Wastewater Collection System project, Cam Le district; and cancel the E-HSDT Evaluation Report dated August 1 of the bid evaluation expert team.

On August 6, Mr. Nguyen Minh Huy, Director of the Danang Traffic Construction Investment Project Management Board, signed Official Dispatch No. 941 in response to the petition of the BDCC-CC1 Joint Venture.

Accordingly, in the E-HSDT, the BDCC-CC1 Joint Venture submitted 6 economic contracts to prove that the manufacturer (Hong Ha Environmental Mechanical Company Limited) has experience in manufacturing and supplying various types of flap doors.

The results of the Inviting Party's probability check show that Contract No. 01/VDIC-HH-2022 dated May 20, 2022 on the production and supply of automatic electric butterfly valves between Hong Ha Environmental Mechanical Co., Ltd. and VDIC Engineering Co., Ltd. has not been implemented. Hong Ha Environmental Mechanical Co., Ltd. confirms that, in fact, this enterprise has never produced butterfly valves with the specifications as in Contract No. 01/VDIC-HH-2022.

“Bach Dang Construction Corporation - JSC using this document to participate in the bidding shows signs of intentionally providing dishonest information and documents, which can distort the results of contractor selection, violating prohibited acts in bidding as prescribed in Article 16 of the 2023 Law on Bidding” - the official dispatch of the Management Board of Investment and Construction Projects of Traffic Works in Da Nang stated.

During the process of evaluating the Bidding Documents, the Inviting Party discovered that the Bidding Documents had signs of dishonesty, so it verified the matter, not that the Bidding Documents had unclear content. Therefore, the Inviting Party did not request the Bidding Joint Venture to clarify.

Next, on August 8, after receiving Official Dispatch No. 941 in response to the request of the BDCC-CC1 Joint Venture from the Management Board of the Danang Traffic Construction Investment Project, the BDCC-CC1 Joint Venture continued to send Official Dispatch No. 148 to the Danang Department of Planning and Investment and the Management Board of the Danang Traffic Construction Investment Project.

Official dispatch No. 148 of the BDCC-CC1 Joint Venture stated: “When implementing the bidding documents, we signed with Hong Ha Environmental Mechanical Company Limited, a reputable domestic valve equipment manufacturing enterprise that can produce, supply and install sluice gate valves and electric butterfly valves that meet the requirements of the bidding documents.

However, when reviewing our bidding documents, the Project Management Board and the bid evaluation team did not allow us to explain or clarify, but hastily accused us of being dishonest…”

The BDCC-CC1 consortium also believes that the content of Official Dispatch No. 941 of the Management Board of Investment and Construction Projects of Da Nang Traffic Works is: "generalizing, not thorough, lacking objectivity, negative inference, and at the same time affecting the reputation of the enterprise".

On August 13, the Management Board of Danang Traffic Construction Investment Projects sent Official Dispatch No. 967 to the BDCC-CC1 Joint Venture stating: "The contractor's response to the E-HSDT evaluation results and contractor selection results has been clearly and fully responded by the Project Management Board in Official Dispatch No. 941 dated August 6."

A large bid is in turmoil after the bidding results were announced.
