Do purchases under 50 million need a contractor selection plan?

(Chinhphu.vn) - Ms. Nguyen Thanh Huyen (Hanoi) asked, for a propaganda package on newspapers and television worth less than 50 million VND, does the Chairman of the Provincial People's Committee need to issue a decision to assign the budget to the department or branch to implement? If there is a decision to assign the budget, what value will need to be established and approved for the contractor selection plan?

On this issue, the Ministry of Finance has the following opinion:

Pursuant to Clause 1, Article 93 of Decree No. 214/2025/ND-CP, the selection of contractors for procurement estimates shall be carried out according to the procedures prescribed in Chapters I, II, III, IV, V, VI, VII and VIII of this Decree, without having to submit or approve a procurement decision.

Accordingly, it is not necessary to approve the purchasing decision to make purchases within the purchasing budget.

According to the provisions of Clause 4, Article 80 of Decree No. 214/2025/ND-CP, for bidding packages or procurement contents with a price of no more than 50 million VND, the head of the purchasing agency or unit is responsible for deciding on the procurement to ensure savings and efficiency and is responsible for his/her own decisions, does not have to meet the conditions for bidding specified in Clause 2, Article 79 of this Decree (including conditions on the contractor selection plan), does not have to follow the procedures specified in Clause 3 of this Article but must ensure a complete invoice and document regime according to the provisions of law or is carried out according to the shortened bidding procedure specified in Clause 3 of this Article.

Accordingly, purchases with a value of no more than VND 50 million do not require a contractor selection plan; in case the purchase content does not exceed VND 50 million and forms a bidding package to select a contractor, follow the instructions in note 1, Section IV of the Contractor Selection Plan Submission Form issued with Circular No. 79/2025/TT-BTC.

Regarding the allocation of budget estimates, citizens are requested to study and comply with the provisions of law on finance and budget.
