Improve the quality of reviewing legal documents

The system of legal documents has a great impact, creating a legal corridor in ensuring the effective operation of the state apparatus, contributing to improving the effectiveness of state management. In recent times, the work of building, inspecting and reviewing legal documents has always been focused on by the province, leading and directing effective implementation, gradually entering into order and quality.

The Provincial People's Council and Provincial People's Committee have paid attention to leading and directing the work of drafting legal documents at the local level; the awareness and thinking of responsible entities in drafting legal documents have increasingly changed positively; resources for this activity are guaranteed, meeting the requirements of drafting legal documents.

The order and procedures for issuing legal documents in the past time in the province have been seriously implemented by agencies and units, ensuring compliance with regulations. Agencies and units have promoted their functions, tasks and responsibilities in advising on drafting, promulgating and implementing legal documents of the province; promptly reviewing with legal documents of higher levels and the actual situation of the locality to advise the Provincial People's Council and People's Committee to promulgate.

In the first 6 months of 2024, the whole province issued 65 legal documents (05 resolutions and 60 decisions), of which the provincial level issued 23 documents (4 resolutions, 19 decisions), the district level issued 33 documents (1 resolution, 32 decisions), the commune level issued 9 documents (9 decisions), an increase of 16 documents (32.65%) compared to the same period in 2023. 100% of documents issued by People's Councils and People's Committees at all levels were appraised before promulgation. Judicial agencies appraised 3 proposals for drafting resolutions and 62 draft legal documents, an increase of 5 drafts (8.77%) compared to the same period in 2023. Of which, the Department of Justice appraised 3 proposals for drafting resolutions; 7 draft resolutions of the Provincial People's Council and 18 draft decisions of the Provincial People's Committee; participated in commenting on 53 draft legal documents of the province, 15 draft legal documents of the Central Government and 56 other drafts sent by departments and branches. For the district level, the Department of Justice has appraised 37 drafts, on which basis the district level has issued 1 resolution and 32 decisions.

The work of inspecting, reviewing and systematizing legal documents has always been focused on by the leadership, direction and implementation to ensure compliance with the provisions of the Law and decrees. The institution on inspecting, reviewing and systematizing legal documents of the province has been issued in full and timely manner, creating a legal corridor for the work to be carried out effectively. Every year, the Provincial People's Committee issues a plan to inspect, review and systematize legal documents. In addition to directing and guiding specialized agencies as well as coordinating with the Provincial People's Council to carry out the work of self-inspecting, reviewing and handling documents issued by the Provincial People's Council and People's Committee; the province also assigned the Department of Justice to preside over and coordinate the inspection of the work of building, promulgating, reviewing and systematizing legal documents in localities in the province.

Based on the province's plan, departments, branches, and localities all issued plans to self-inspect, review, and systematize legal documents of their agencies and units. In particular, the Department of Justice self-inspected 22 legal documents issued by the Provincial People's Committee, coordinated with the Legal Committee of the Provincial People's Council to self-inspecte 4 legal documents issued by the Provincial People's Council, and inspected 34 documents sent by localities according to their authority. The Department established an inspection team to inspect documents in Tien Yen and Ba Che. Through the inspection, 8 inappropriate documents were discovered and recommended handling according to regulations.

The work of reviewing and systematizing legal documents is also carried out regularly, promptly detecting illegal, contradictory, overlapping, expired or no longer suitable regulations in accordance with the socio -economic development situation in order to promptly suspend the implementation, abolish, replace, amend, supplement or issue new documents, ensuring the constitutionality, legality, unity and synchronization of legal documents of the People's Council and People's Committee in the legal system and in accordance with the socio-economic development situation.

The Department of Justice coordinates with departments and branches to review and submit to the Chairman of the Provincial People's Committee to announce the list of documents that have expired or ceased to be effective in 2023; announce the results of reviewing and systematizing legal documents of the Provincial People's Council and People's Committee for the 2019-2023 period; advise the Provincial People's Committee to issue a document directing the implementation of Decision No. 143/QD-TTg dated February 2, 2024 of the Prime Minister on the Project "Improving the quality and efficiency of exploiting the Code of Laws".

In the coming time, the Judicial sector will continue to closely coordinate with departments, branches and localities; strengthen professional and technical guidance, and continuously improve the quality to meet the increasingly high requirements of the work of building, inspecting, reviewing and systematizing legal documents.
