1. What conditions must a learner driver meet?
Specifically, Article 7 of Circular 12/2017/TT-BGTVT (amended in Circular 38/2019/TT-BGTVT) stipulates the conditions for driving learners, including:
- Being a Vietnamese citizen, a foreigner who is allowed to reside or is working or studying in Vietnam.
- Be of age (as of the driving test date), in good health, and have the required educational level; for those studying to upgrade their driving license, they can study in advance but can only take the test when they are of age as prescribed.
- Students who want to upgrade their driving license must have enough driving time or practice time and safe driving kilometers as follows:
+ Class B1 automatic to B1: driving time from 01 year or more and 12,000 km of safe driving or more;
+ Class B1 to B2: driving time from 01 year or more and 12,000 km of safe driving or more;
+ Class B2 to C, C to D, D to E; Classes B2, C, D, E to F respectively; Classes D, E to FC: working time from 03 years or more and 50,000 km of safe driving or more;
+ Class B2 to D, C to E: working time from 05 years or more and 100,000 km of safe driving or more.
In case a learner upgrades his/her administrative violation in the field of road traffic with the form of revocation of the right to use a driving license, the safe driving time is calculated from the date of completion of the administrative violation penalty decisions.
- Students who want to upgrade their driving license to classes D or E must have a junior high school diploma or equivalent.
2. Form of training for driving learners
Pursuant to Article 8 of Circular 12/2017/TT-BGTVT, the form of driver training is regulated as follows:
- People who need to be granted driving licenses for classes A1, A2, A3, A4 and cars class B1 can self-study theory subjects, but must register at a licensed training facility to review and test; for classes A4, B1, they must be tested and granted training certificates.
- People who need to be granted driving licenses of classes B2, C, D, E and driving licenses of class F must be trained at a facility authorized to train and must be tested for primary certificates or training certificates. Within 01 (one) year from the date the training facility finishes testing and considers the recognition of graduation from the training course, if the test for primary certificates or training certificates is not conducted, they must be retrained in a new course.
3. Driver's learner profile
According to Article 9 of Circular 12/2017/TT-BGTVT (amended in Circular 38/2019/TT-BGTVT, Circular 01/2021/TT-BGTVT), the documents of driving learners are as follows:
- First-time driving learners must complete 01 set of documents and submit them directly to the training facility. The documents include:
+ Application for studying and testing to obtain a driving license according to the form prescribed in Appendix 7 issued with Circular 12/2017/TT-BGTVT;
+ Copy of valid identity card or citizen identification card or passport with the identity card number or citizen identification card number for Vietnamese people; valid passport for Vietnamese people residing abroad;
+ Copy of passport valid for more than 06 months and temporary residence card or permanent residence card or diplomatic identity card or official identity card for foreigners;
+ Driver's health certificate issued by a competent medical facility as prescribed.
- Forklift driver trainees prepare 01 set of documents and submit directly to the training facility. The documents include:
+ Documents specified in Clause 1, Article 9 of Circular 12/2017/TT-BGTVT;
+ Declaration of working time and safe driving kilometers according to the form prescribed in Appendix 8 issued with Circular 12/2017/TT-BGTVT and must be responsible for the content of the declaration before the law;
+ Copy of junior high school diploma or equivalent or higher degree in case of upgrading driver's license to class D, E (present original when checking exam application documents);
When learning to drive comes to submit their application, the training facility will take a photo and store it in the driver's license database.
- Ethnic minorities who cannot read or write Vietnamese and want to learn to drive a class A1 or A4 motorbike must prepare one set of documents and submit it directly to the training facility. The documents include:
+ Documents specified in Point b and Point d, Clause 1, Article 9 of Circular 12/2017/TT-BGTVT;
+ Certificate of confirmation from the People's Committee of the commune, ward or town where the person resides, confirming that the person is an ethnic minority who cannot read or write Vietnamese according to the form prescribed in Appendix 24 issued with Circular 12/2017/TT-BGTVT; the certificate is valid for 01 year from the date of signing the confirmation; the individual signs or fingerprints the confirmation.
