Questioning at the 8th Session of the 15th National Assembly, delegate Trang A Duong ( Ha Giang Delegation) reflected the reality of many companies, investors, and private clinics challenging state management agencies in the health sector. That is, after being administratively sanctioned and temporarily suspended for 3-4 months, these units declared dissolution and then established new companies and opened other clinics. Meanwhile, the management staff and medical staff were all the same people as before, even operating at the same location with a completely new name.

Delegates of Ha Giang province requested the Minister of Health to propose solutions to completely handle the above situation.

Minister of Health Dao Hong Lan said that according to the provisions of the Law on Medical Examination and Treatment, each facility is granted a single operating license. This is the basis for private clinics to practice and must meet the conditions on facilities, medical equipment, and human resources. With the condition on human resources, the unit is required to have a number of full-time employees, practitioners must register and meet conditions such as not being allowed to practice at two facilities at the same time.

If a practitioner works full-time at a medical facility, when that facility is suspended, he or she cannot immediately work for another facility, but must terminate the labor contract at the facility that just violated.

Practice over the years has shown that some private clinics have been suspended due to the fault of the person in charge of the professional expertise of that facility. Therefore, when violating, depending on the level, the person in charge of the main professional expertise may have their practice license revoked and cannot operate immediately. Clinics that want to operate again must comply with regulations and meet the requirements to be granted a license.

Minister Dao Hong Lan affirmed that, through the delegates' reflection, the Ministry of Health has acknowledged and will pay attention during the implementation of the provisions of the Law on Medical Examination and Treatment, especially related to violations, to avoid abuse and exploitation.
