Who is eligible to buy social housing?

Social housing is an important part of social security policy, helping to solve the housing needs of low-income people who are not eligible to buy, rent or rent houses at market prices. With incentives on selling prices and bank loan interest rates, social housing projects always attract the attention of people who want to buy houses.

However, not everyone is eligible to buy social housing. So, according to the law, who are eligible to buy social housing?

According to Article 49 of the 2014 Housing Law, subjects are eligible to buy social housing if they meet all the conditions in Article 51 of the 2014 Housing Law, including:

- People with revolutionary contributions according to the law on preferential treatment for people with revolutionary contributions;

- Poor and near-poor households in rural areas;

- Households in rural areas frequently affected by natural disasters and climate change;

- Low-income people, poor and near-poor households in urban areas;

- Workers working at enterprises inside and outside industrial parks;

- Officers, professional non-commissioned officers, technical non-commissioned officers, professional soldiers, workers in agencies and units of the people's police and people's army;

- Cadres, civil servants and public employees according to the provisions of law on cadres, civil servants and public employees;

- Subjects who have returned public housing according to regulations are tenants of public housing who are no longer eligible to rent housing or move elsewhere or violate regulations on housing management and use and are subject to repossession, must return public housing to the State.

- Households and individuals whose land is subject to land recovery and whose houses must be cleared and demolished according to the provisions of law but have not yet received compensation from the State in the form of houses and residential land.

In addition to being among the subjects eligible to buy social housing above, buyers must also meet the conditions prescribed in Article 51 of the 2014 Housing Law, including:

Housing conditions : People who do not own a house, have not bought, rented or leased to buy social housing, have not enjoyed housing or land support policies in any form at the place of residence or study, or have a house owned but the average housing area per capita in the household is lower than the minimum housing area prescribed by the Government for each period and each region.

Residence conditions : Buyers of social housing must have permanent residence or temporary residence registration but have paid social insurance for 1 year or more in provinces and cities with social housing development projects.

Income conditions: Home buyers are not subject to regular income tax according to personal income tax regulations; people from poor households are subjects within the poverty line according to government regulations. For officials and civil servants, they must be subject to not pay regular income tax according to personal income tax laws. If they are social protection subjects and want to buy social housing, they must have confirmation from the People's Committee of the commune/ward/town where they reside. Students are only allowed to rent, not buy, social housing.

People who meet the above conditions must register to buy with the investor of social housing projects. After the documents are approved, the investor and the buyer will discuss and agree on signing a sales contract, the detailed implementation process is in accordance with the provisions of Decree 100/2015/ND-CP.

In addition, social housing buyers need to pay attention to the regulations on selling social housing (if there is a need to sell) such as: the minimum period is 5 (five) years, from the date the buyer has fully paid for the purchase or lease purchase of the house and has a need to sell the house, then the purchase and sale activities can be carried out. The purchase and sale activities must comply with the provisions of Article 62 of the 2014 Housing Law.

In case within 5 years from the date the buyer or lessee has fully paid for the purchase or lease purchase of the house and has a need to sell the house, it can only be sold to the social housing management unit or sold to a subject eligible to buy social housing if this unit.

Recently, discussing the draft Law on Housing (amended), National Assembly deputies said that it is necessary to develop social housing for rent to reduce the financial burden on low-income people. The reason is that in reality, low-income people are mainly workers and new workers, for whom housing is an asset that is too large and beyond their means. In addition, there is a situation of falsifying income to buy a house or speculators borrowing the names of workers to register to buy.

Currently, in many countries, investors only implement the project, while the management and operation will be undertaken by professional public or private organizations. These organizations work alongside investors from the time of project development, commit to buying houses at reasonable prices for long-term rental and solve the investor's cash flow concerns. Thanks to that, low-income people are not sure to own a house but have the right to live there.
