At the regular press conference of the Ministry of Finance on the afternoon of January 19, Deputy Director General of the General Department of Taxation Mai Son discussed many issues surrounding the issue of environmental protection tax debt of key petroleum trading enterprises.

Mr. Mai Son said that out of 34 petroleum trading enterprises, nearly 10 enterprises have tax debts. Currently, the General Department of Taxation is closely controlling the tax debts of enterprises in general, and local tax departments have fulfilled all related responsibilities in implementing tax management regulations.
The General Department of Taxation's leaders stated that, in accordance with the provisions of the Law on Tax Administration, enterprises must self-declare, self-pay, self-calculate and be responsible before the law. Tax authorities will inspect, monitor and urge tax debts with the obligation to pay to the state budget. Regarding the management of business cash flow, if there are violations, they will be handled through inspection and examination.
"Recently, tax authorities have urged and enforced tax debt collection in accordance with the law," Mr. Son affirmed.
Regarding the process, Mr. Son added: when units incur debts starting from the 91st day onwards, the tax authority will enforce the account; from the 121st day, it will enforce the invoice.
"In addition, other coercive measures will be applied according to tax management laws related to legal representatives, such as banning exit; identifying and seizing assets...", Mr. Mai Son said.
To prevent businesses from owing taxes, in 2024, the tax industry will focus on building a database related to businesses' financial reports based on financial reports and business establishments.
Speaking at the press conference, Deputy Minister of Finance Nguyen Duc Chi emphasized that tax management is based on the principle of enterprises self-declaring and self-paying, and tax authorities supervise. Regarding cash flow, if enterprises violate after review, the authorities will handle it according to the law.
Previously, in early January, the Government Inspectorate issued a notice concluding the inspection of compliance with policies and laws in state management of petroleum.
The inspection results also showed that due to the General Department of Taxation and many tax departments' incomplete and incorrect implementation of regulations and lack of inspection and supervision, many key petroleum traders owed thousands of billions of VND in environmental protection tax for many periods and many years.
The Government Inspectorate determined that as of September 30, 2022, 6 out of 15 inspected petroleum traders owed environmental protection tax with a total amount of more than VND 3,219 billion.
Notably, despite still owing the state budget environmental protection tax, some key petroleum traders have lent thousands of billions of dong to many individuals for personal use.
In particular, from 2017 to 2022, Thien Minh Duc Group Joint Stock Company lent Mr. Chu Dang Khoa, Deputy General Director, and Ms. Chu Thi Thanh, Chairwoman of the Board of Directors of this company, more than 7,485 billion VND. At the time of inspection, the two individuals mentioned above still owed the company a total of more than 1,396 billion VND.
Similarly, Xuyen Viet Oil Trading, Transport and Tourism Company Limited has a negative equity of more than 462 billion VND, owes the State more than 1,246 billion VND in environmental protection tax; owes the price stabilization fund more than 212 billion VND.
