Tightly manage mineral exploitation activities under new law

The Department of Agriculture and Environment of Tay Ninh province requires organizations and individuals licensed to operate in the mineral sector in the area to urgently review their licenses and carry out transitional procedures to ensure the unified implementation of the Law on Geology and Minerals 2024, effective from July 1, 2025.

Mineral exploitation enterprises must review the entire project for safety and environmental protection criteria.

Accordingly, mineral exploitation licenses issued before July 1, 2025 must be reviewed and compared with the new regulations. In case of non-compliance, enterprises must prepare a dossier to request a replacement within 36 months. After this period, the license that has not been replaced will be temporarily suspended.

Units that have had decisions approving mineral reserves but have not yet submitted applications for licenses must also exercise their priority rights within 36 months as prescribed.

For expired licenses, the Department requires enterprises to immediately cease mining activities, and at the same time prepare and submit to competent authorities a mine closure plan and an environmental restoration report. Projects with processing items that have not yet been implemented must report the cause and propose a solution.

Regarding financial obligations, units must compile statistics on exploited output, inventory remaining reserves and complete settlement records for mining rights fees before December 31, 2025.

In addition, mining enterprises must review the entire project for safety and environmental protection criteria; upgrade technology if it is outdated or causing pollution; install weighing equipment, surveillance cameras at mine entrances and exits, and vehicle tracking devices to control actual mining output.

For the People's Committees of communes and wards, the Department recommends strengthening measures to protect unexploited mineral resources, promptly preventing illegal exploitation, and at the same time stepping up propaganda and mobilizing people not to participate in or assist in violations; closely coordinating with functional agencies in inspection and supervision work./.
