National Assembly passes Data Law, regulating cross-border data processing

(Dan Tri) - The Data Law recently passed by the National Assembly regulates the transfer and processing of cross-border data, and cases where data must be provided to State agencies.

On the afternoon of November 30, with 451/458 delegates present in favor, the National Assembly passed the Data Law. The law takes effect from July 1, 2025.

The recently passed law has provisions on the transfer and processing of cross-border data. Accordingly, agencies, organizations and individuals are free to transfer data from abroad to Vietnam, process foreign data in Vietnam, and have their legitimate rights and interests protected by the State in accordance with the provisions of law.

Transfer of core data and important data includes: Transfer of data stored in Vietnam to data storage systems located outside of Vietnam.

Vietnamese agencies, organizations and individuals transfer data to foreign organizations and individuals in Vietnam. Vietnamese agencies, organizations and individuals use processing platforms outside of Vietnam to process data.

The transfer and processing of data as prescribed above must ensure national defense, security, protection of national interests, public interests, rights and legitimate interests of data subjects and data owners in accordance with the provisions of Vietnamese law and international treaties to which Vietnam is a member. The Law assigns the Government to specify this in detail.

The Law encourages domestic and foreign organizations and individuals to provide proprietary data to State agencies.

Organizations and individuals must provide data to State agencies upon request from competent authorities without the consent of the data subject in the following cases: Responding to emergencies; When there is a threat to national defense and security but not to the extent of declaring a state of emergency; Disasters; Prevention and control of riots and terrorism.

In addition, the State agency receiving the data is responsible for using the data for the right purpose.

This agency also ensures data security, safety, data confidentiality protection, and other legitimate interests of data subjects, organizations, and individuals providing data according to the provisions of law...
