According to the provisions of Clause 6, Article 9 of the Law on Road Traffic Order and Safety 2024, the act of holding and using a phone or other electronic device while driving a vehicle on the road is strictly prohibited.

Specifically, drivers of vehicles participating in traffic while moving on the road are not allowed to hold and use the phone. In case an individual mounts the phone on a stand to view Google Maps without holding and operating the phone while driving, he/she does not violate the above regulations.

However, using a phone (even on a holder) must still ensure traffic safety.

Penalty for holding and using phone while driving motorbike in 2025

According to Decree 168 effective from January 1, 2025, the penalty for using a hand-held phone while driving a motorbike is as follows:

Fines of VND800,000 to VND1 million will be imposed on drivers using umbrellas, audio equipment (except hearing aids), using hand-held devices, and using phones or other electronic devices. At the same time, 4 driving license points will be deducted.

A fine of 10-14 million VND will be imposed on drivers who use umbrellas, audio equipment (except hearing aids), handle and use phones or other electronic devices that cause traffic accidents. In addition to the fine, 10 driving license points will be deducted.

Thus, motorcyclists who hold and use a phone while driving will be fined from 800,000 VND to 1 million VND. In case of holding and using a phone while driving and causing an accident, the fine will be from 10 to 14 million VND. In addition, points will be deducted from the driver's license.

Latest fines for motorbikes without mirrors

According to the above regulations, motorbikes participating in traffic must have a left rearview mirror to ensure visibility for the driver. In case a motorbike does not have a left rearview mirror or has one but it is not functional, it will be fined from 400,000 to 600,000 VND.

What is a motorcycle with mirrors but no function?

Specifically, motorcycle rearview mirrors must meet the standards prescribed by law. Rearview mirrors must be securely installed. The driver can adjust the viewing area at the driving position.

The reflecting surface of the rear-view mirror must be convex and clearly visible at a distance of at least 50 m to the right and left, or the center of the reflecting surface of the mirror must be at a distance of at least 280 mm from the longitudinal median plane of the vehicle.

In the case of circular mirrors, the diameter of the reflecting surface shall not be less than 94 mm and not greater than 150 mm.

In the case of non-circular mirrors the dimensions of the reflecting surface must be such that an inscribed circle of diameter 78 mm is contained within a rectangle of dimensions 120 mm x 200 mm.

Thus, if a motorbike has mirrors but does not meet the above conditions, it will be considered a motorbike with mirrors but without function.

Fine for driving in the wrong lane with motorbike

Decree 168 stipulates that drivers of motorbikes, mopeds, and other similar vehicles will be fined from VND 600,000 to VND 800,000 (previously from VND 400,000 to VND 600,000) when committing the following violations:

Driving on the wrong side of the road;

Driving in the wrong lane or section of the road (lane in the same direction or lane in the opposite direction);

Drive the vehicle across the fixed median strip between the two lanes of traffic.

In addition, if a motorcyclist drives in the wrong lane and causes a traffic accident, he/she will be fined from 10 to 14 million VND (previously from 4 to 5 million VND) and have 10 points deducted from his/her driving license.

Thus, it can be seen that the fine for driving in the wrong lane with motorbikes from 2025 has been increased, in which the fine for driving in the wrong lane causing traffic accidents has increased sharply.
