Authority of People's Committees at 2 levels to resolve subsidy regime for youth volunteers

(Chinhphu.vn) - The Ministry of Home Affairs regulates the authority of the People's Committees at the commune level and the People's Committees at the provincial level, and the procedures and time limit for settling the subsidy regime for youth volunteers who have completed their tasks in the resistance war.

The Ministry of Home Affairs prescribes the authority of the People's Committees at the commune level and the People's Committees at the provincial level and the procedures and time limit for settling the subsidy regime for youth volunteers who have completed their tasks in the resistance war.

The Ministry of Home Affairs issued Circular No. 09/2025/TT-BNV regulating the division of authority and decentralization of state management tasks in the field of home affairs.

Application for allowance for youth volunteers who have completed their duties in the resistance war

According to the Circular, the dossier for considering the allowance regime for youth volunteers who have completed their tasks in the resistance war is prescribed in Article 4 of Joint Circular No. 08/2012/TTLT-BLDTBXH-BNV-BTC dated April 16, 2012 of the Minister of Labor - Invalids and Social Affairs, Ministry of Home Affairs, Ministry of Finance guiding the implementation of the allowance regime for youth volunteers who have completed their tasks in the resistance war according to Decision No. dated July 27, 2011 of the Prime Minister, amended and supplemented in Circular No. 08/2023/TT-BLDTBXH dated August 29, 2023 of the Minister of Labor - Invalids and Social Affairs, including:

1. One of the following documents proving youth volunteer status (original or certified copy by the People's Committee at the commune level):

- Cadre or party member resume declared before April 29, 1999;

- Documents issued by competent authorities before the youth volunteer returns to the locality such as: Certificate of completion of tasks from the youth volunteer management unit; Medical transfer, hospital transfer, health certificate; Certificate of merit during the time participating in the youth volunteer force; Certificate of participation in the youth volunteer force; Certificate of work transfer, appointment, task assignment;

- In case the youth volunteer no longer has one of the documents specified in points a and b of this clause, he/she must submit a declaration certified by the People's Committee of the commune where he/she registered his/her permanent residence before joining the youth volunteer (original). The People's Committee of the commune is responsible for confirming the declaration for the subject who is a local person joining the youth volunteer but is currently registered as a permanent resident in another locality (confirmation content according to Form No. 08 Appendix I attached to this Circular).

2. Personal statement, specifically:

- In case the youth volunteer is still alive, make a request for one-time allowance according to Form No. 05 Appendix I attached to this Circular;

b) In case a youth volunteer has passed away, the youth volunteer's relatives shall prepare a declaration according to Form No. 06, Appendix I attached to this Circular;

c) In case of request for monthly allowance, make according to Form No. 07 Appendix I attached to this Circular.

3. For subjects eligible for monthly allowance, in addition to the documents specified in Clauses 1 and 2 of this Article, there must be a health certificate from a Hospital or Regional Medical Center or higher (original).

Authority of the People's Committee at the commune level and the People's Committee at the provincial level

The Circular clearly states the authority of the People's Committees at the commune level and the People's Committees at the provincial level, and the procedures and time limits for settling the allowance regime for youth volunteers who have completed their tasks in the resistance war. Specifically, the settlement of allowance regime for youth volunteers who have completed their tasks in the resistance war as prescribed in Article 5 of Joint Circular No. 08/2012/TTLT-BLDTBXH-BNV-BTC is implemented as follows:

The youth volunteer or the relative of the youth volunteer (in case the youth volunteer has passed away) submits 01 set of documents according to the above regulations to the People's Committee of the commune where they register their permanent residence.

Within 05 working days from the date of receiving complete documents as prescribed (in each batch), the People's Committee at the commune level is responsible for: Organizing a conference and making a record confirming the dossier for consideration of the allowance regime according to Form No. 08 Appendix I attached to this Circular - The conference consists of representatives of commune-level leaders (People's Committee, Party Committee, Fatherland Front, Association of Former Youth Volunteers or Liaison Committee of Former Youth Volunteers), Head of the village with the youth volunteer object requesting to resolve the allowance regime; synthesizing the dossier for consideration of the allowance regime for the youth volunteer and reporting to the People's Committee at the provincial level through the Department of Home Affairs.

Within 10 days from the date of receiving complete documents as prescribed (in batches), the Provincial People's Committee is responsible for:

Complete review, appraisal, synthesis, and issue decisions on enjoying subsidy regimes according to Form No. 09, Form No. 10, Form No. 11, with a summary table of the list of youth volunteers requesting to enjoy subsidy regimes made according to Form No. 12, Form No. 13, Form No. 14 Appendix I attached to this Circular.

In case a youth volunteer no longer has one of the supporting documents specified in Point a, b, Clause 1 above, compile and transfer the list of subjects to the Provincial Association of Former Youth Volunteers for inspection, confirmation, and consultation before making a decision.

Complete the compilation of the list of beneficiaries of one-time subsidies according to Form No. 15, Appendix I attached to this Circular after the Decision on settlement of subsidies for youth volunteers (in each batch) is issued, along with an official dispatch requesting additional budget estimates for one-time subsidies, and send 2 copies to the Ministry of Home Affairs. At the same time, organize the payment of monthly subsidies to beneficiaries according to current regulations.

Keep records of beneficiaries of subsidy regimes according to regulations.

This Circular takes effect from July 1, 2025.
