On December 1, according to Thanh Nien reporter's source, the Inspectorate of Ca Mau province has just concluded an inspection (KLTT) of the responsibility for implementing legal regulations on corruption prevention and control and inspecting the implementation of policies and laws in the management of public land and forest land for the Chairman of the People's Committee of Dam Doi district. The inspection period is from January 1, 2020 to December 31, 2022.

Leasing public land without proper authority

According to the Inspectorate of Ca Mau province, the People's Committee of Dam Doi Town signed a contract to lease land to TT Company (Ly Van Lam commune, Ca Mau city) with an area of ​​7,753 m2 for a period of 3 years to serve as a wharf for gathering construction materials for the company (on May 2, 2007, the People's Committee of Dam Doi District issued Official Dispatch No. 436/UBND-VP approving the policy for the People's Committee of Dam Doi Town to sign a land lease contract with TT Company).

According to the report of the People's Committee of Dam Doi Town, from 2021 to present, the People's Committee of the town has invited Mr. TVT, Director of TT Company to work and discuss related to the land lease contract; at the same time, requested to liquidate the contract and return the leased public land. However, during the invitation to work, the company representative did not cooperate well with the People's Committee of Dam Doi Town and up to now, TT Company is still using the above land area.

The Inspectorate of Ca Mau province concluded that the People's Committee of Dam Doi town leased public land without proper authority according to the provisions of Clause 1, Article 37 of the 2003 Land Law.

Off-book land rental fees and entertainment expenses

Through inspection and comparison before the inspection period, Ca Mau Provincial Inspectorate determined that the total public land area of ​​Dam Doi District for lease is 68.9 hectares.

In 2006, Tan Dan Commune People's Committee leased 40 hectares of land in Nam Chanh Hamlet to 16 households for the period from 2006 to 2017. The rental price in 2006 - 2009 was 3 million VND/ha/year; in 2010 - 2011 it was 5 million VND/ha/year; in 2012 - 2017 it was 7 million VND/ha/year. On January 18, 2018, Tan Dan Commune People's Committee terminated the contract with the above households, but to this day they are still managing, using and cultivating the land without paying the rent.

The amount of money collected from land lease from 2006 - 2014 was more than 1.3 billion VND (after deductions and reductions), but the People's Committee of Tan Dan commune only paid 278 million VND to the budget. The remaining amount was kept off the books, spent on collective agencies, public welfare projects and other expenses of more than 976 million VND. The commune is managing the remaining amount of 144 million VND, including the money lent to a cooperative of 40 million VND.

From 2015 to now, the revenue from land lease is more than 716 million VND (after deducting exemptions and reductions), the Commune People's Committee paid 543 million VND to the budget, the remaining 172 million VND the Commune People's Committee did not pay to the commune budget but mainly spent to support the operating costs of the commune's departments, branches, and organizations; personal business expenses; and reception expenses (including the amount of money the commune lent to the commune treasurer that has not been recovered, 25 million VND), the remaining 787,000 VND the commune is managing.

The inspector also discovered that in 1999, the People's Committee of Tan Thuan Commune leased 24 hectares of land to 5 households. On June 3, 2020, the People's Committee of Tan Thuan Commune issued a notice to terminate the contract. However, these 5 households did not return the land, continued to use it, and even requested the competent authority to... issue a certificate of land use rights for stable use.

Land rental fee from 2008 - 2020 with total contract revenue of 1.56 billion VND, but the commune only collected 670 million VND, the uncollected amount was more than 889 million VND (due to economic difficulties, these households could not pay). The collected amount was paid into the budget, the commune used to balance the annual budget.

In 2015, Tan Trung Commune People's Committee leased 4.9 hectares of land to a household. On December 15, 2020, the lessee returned the leased land to the commune for management until now. The amount of money collected from leasing the land is 171 million VND. The commune has paid it to the commune's other annual state budget revenue sources and used it to repair rural roads, cultural activities, social security, etc.

The Inspectorate of Ca Mau province recommends that the Chairman of the People's Committee of Dam Doi district direct specialized agencies to inspect the revenue and expenditure of the People's Committees of Tan Thuan, Tan Dan, and Tan Trung communes regarding the collection and expenditure of public land rental fees; and at the same time, handle responsibilities according to the provisions of law.
