Strict handling, not allowing construction violations to be legalized

Forced demolition of illegal constructions, not "punishment but allowing them to exist"

On July 30, informing Nguoi Dua Tin , a representative of the Department of Construction of Ba Ria - Vung Tau province said that this agency had issued document No. 2997/SXD-QLXD signed by Deputy Director Khai Quoc Binh to departments, branches, and People's Committees of districts and cities in the area regarding strengthening the management of construction investment activities.

Accordingly, the Department of Construction of Ba Ria - Vung Tau province has made recommendations and provided guidance on handling issues related to compliance with construction planning, construction permits, and construction quality management for management units and investors to seriously implement.

Specifically, regarding the handling of illegal and improper construction works: localities and departments should strengthen inspection and management of the area, promptly handle (or coordinate in handling) organizations and individuals that violate construction order.

In particular, for construction without permission, illegal construction, construction not in accordance with the planning approved by competent authorities and incomplete implementation of regulations on management of construction investment projects.

Regarding handling of unaccepted works that have been put into use: promptly detect and correct investors for construction acts that are not in accordance with the construction permit, especially violations of height and exceeding construction density, forcing acceptance before putting the work into use according to Official Dispatch No. 252/SXD-QLXD dated January 18, 2023 of the Department of Construction on strictly implementing the provisions of law on acceptance of construction works before putting them into operation and use.

For construction works with violations of construction order, it is necessary to have measures to handle violations to ensure compliance with legal regulations, overcome the situation of sanctions but still allowing them to exist, legalizing violations of individuals and organizations in the field of construction activities, and resolutely apply measures to force the demolition of violating construction works according to regulations.

Violations must be detected early, timely preventive measures applied, and strict enforcement of law and discipline must be ensured.

After issuing decisions on handling administrative violations in the field of construction order, localities need to organize inspections of violations with remedial measures applied to improve the effectiveness of handling administrative violations in the field of construction.

For projects and works that are noted by the construction professional agency in the notification of the results of the appraisal of the investment feasibility study report on construction, the contents need to be supplemented and completed to be eligible for approval or to implement the next step. At the same time, it is necessary to overcome the existing problems before carrying out the construction permit issuance procedure.

Previously, the People's Committee of Ba Ria-Vung Tau province also directed to strengthen inspections to put an end to the situation of encroachment on public land, illegal construction, construction without permits, and construction in violation of planning, which is slow to detect and handle, easily forming "hot spots" of social order.

Focusing on preventing and handling acts of encroachment on public land, using land for the wrong purpose, illegal construction, illegal leveling and upgrading of roads, illegal mining, advertising of real estate business activities in violation of regulations...

The People's Committee of Ba Ria-Vung Tau province requires that inspections must be carried out simultaneously with ensuring that all violations must be detected early, prevented promptly and handled thoroughly to limit cases of forced demolition, causing waste of social assets and easily forming "hot spots" of social order.

Heads of departments, Chairmen of People's Committees of districts, towns, cities and heads of agencies and units are responsible according to the management hierarchy before the Provincial People's Committee. If there is a violation or lax management, or slow detection, the province will resolutely handle it after detecting the violation.

The representative of the Department of Construction of Ba Ria - Vung Tau province also said that recently, this agency has also issued document No. 3017/SXD-TTr to districts, towns, cities and investors, real estate trading floors in the area about the recent time, some websites and social networks have posted introductions of products that are not for the intended use in some apartment projects, tourist villas, and resorts in the area.

According to the Department, through review, these projects have investment objectives for tourism and resort accommodation, not for residential purposes. Therefore, the Department recommends that investors and trading floors introduce the correct nature, scale, and investment objectives to avoid misleading customers; customers also need to carefully research to ensure their legal rights.
