5 contractors of aquaculture infrastructure project in Tra Vinh were revoked, deducted more than 4.2 billion VND

Due to improper acceptance and payment and incorrect calculation, 5 contractors constructing the Aquaculture Infrastructure Project in Tra Vinh province were required to recover and deduct more than 4.2 billion VND.

The Inspectorate of the Ministry of Agriculture and Rural Development (now the Ministry of Agriculture and Environment ) has just issued Conclusion No. 66-2025 on the inspection of investment management in construction of the Infrastructure Project serving aquaculture in Dan Thanh and Truong Long Hoa communes, Duyen Hai town, Tra Vinh province (referred to as the project).

The investor did not detect the contractor's shortcomings and deficiencies.

According to the conclusion, the project was approved by the Minister of Agriculture and Rural Development in 2022 with a total investment of 230 billion VND.

The project investor is the Project Management Board for Investment and Construction of Agricultural and Rural Development Works of Tra Vinh province (referred to as the investor).

The project includes construction items of traffic infrastructure, water supply and drainage systems, electrical systems and transformer stations.

The project aims to contribute to attracting people and businesses to invest in aquaculture development and improve the lives of people in the project area.

By early September 2024, the project had disbursed more than 138 billion VND.

Through inspection of the implementation of project construction contracts, the inspection agency pointed out shortcomings and defects.

Notably, for package No. 17 (construction of works and procurement and installation of equipment), the investor and the consortium of Huy Hoang Construction One Member Co., Ltd., Hiep Thanh Co., Ltd., Dai Dong Hai Construction Investment Joint Stock Company and Lu Gia Electrical Mechanical Joint Stock Company accepted the overpayment of more than VND 735 million.

For the unimplemented contract volume, the investor and the consortium of these companies must deduct the contract amount of VND 3,473 billion due to not carefully reviewing the volume and unit price.

During the on-site inspection of package No. 17, the inspection agency determined that some sections of the embankment were not at the correct design slope, the embankment was still loose, uneven, and eroded a lot due to rain; some concrete slabs on the road surface had cracks; the expansion joints were not constructed according to design; some local embankment reinforcement locations had the phenomenon of cajuput and eucalyptus piles leaning and falling outside the roadbed; some positions of the bridge abutment cone under construction were not compacted according to technical requirements; some electric poles had eroded foundations and tilted poles.

For package 09 (consulting on survey, marking boundaries for site clearance, designing construction drawings and estimating construction costs) implemented by the joint venture of Nam Quoc Consulting and Investment Joint Stock Company and Phuong Bac Construction Investment Consulting Company Limited, the overpayment of 2% VAT with a total amount of more than 81 million VND was also accepted.

For package No. 18 (construction supervision), the investor did not detect any shortcomings or deficiencies in the contractor for construction and equipment procurement and installation (package No. 17).

"The responsibility for the above-mentioned shortcomings and defects belongs to the design and appraisal consultants, construction contractors, supervision consultants and investors," the inspection conclusion stated.

To overcome the shortcomings, deficiencies and defects discovered through the inspection of the Project's construction investment management, the Inspectorate of the Ministry of Agriculture and Rural Development recommends that the Minister and Chairman of the People's Committee of Tra Vinh province direct the investor to organize a review and seriously rectify and draw lessons from the collectives and individuals under its management authority related to the shortcomings, deficiencies and defects.

The investor urged to collect more than 816 million VND due to incorrect acceptance and payment to contractors. At the same time, the contract amount of more than 3,473 billion VND was deducted due to incorrect calculation.

Of which, Huy Hoang Construction LLC recovered nearly 255 million VND and deducted more than 2.4 billion VND; Hiep Thanh LLC recovered more than 245 million VND and deducted more than 669 million VND; Dai Dong Hai Construction Investment JSC recovered more than 234 million VND and deducted more than 364 million VND; Nam Quoc Investment and Consulting JSC and Phuong Bac Construction Investment Consulting LLC recovered a total of more than 81 million VND.

At the same time, direct the design consultant to take measures to fix the culverts that obstruct the flow and waterway traffic and direct the contractor of package 17 to fix and repair the existing problems discovered through field inspection.
