Bac Giang disseminates documents, regulations, and instructions for implementing the 2024 Land Law

On November 21, at the Hall of the People's Committee of Bac Giang City, the Provincial People's Committee held an online conference at 3 levels to disseminate and deploy documents, detailed regulations, and instructions for implementing the 2024 Land Law.

Attending the conference at the provincial bridge were comrades: Mai Son - Acting Chairman of the Provincial People's Committee; Lam Thi Huong Thanh - Permanent Vice Chairman of the Provincial People's Council; reporters of the Ministry of Natural Resources and Environment ; representatives of leaders of departments, branches, agencies, units and legal reporters of the province.

Comrade Mai Son - Acting Chairman of the Provincial People's Committee delivered the opening speech at the conference.

Speaking at the opening of the conference, Comrade Mai Son - Acting Chairman of the Provincial People's Committee said that the Land Law 2024 was approved by the National Assembly to take effect early from August 1, 2024. The shortening of the effective period of the Land Law shows the urgent and important requirements, the scope of influence, and the profound impact of the Law on practical life. From there, it creates a driving force to liberate land potential, promoting the successful completion of socio -economic development goals.

The Provincial People's Committee organized a 3-level online conference to deploy guiding documents and detailed regulations for the implementation of the Land Law in the province to unify and raise awareness and legal consciousness for officials at all levels in the province about the new land law system, contributing to effectively solving problems in land management and use, creating more favorable conditions for people and businesses in accessing land.

In order for the conference to achieve its objectives, Comrade Mai Son requested that the Reporters emphasize new, important, and explanatory content compared to the old Land Law; spend considerable time exchanging, discussing, and answering opinions of conference delegates.

Delegates attending the conference focused on researching and actively responding to the Reporter on issues that were not clearly understood or were existing and difficult in the locality to receive satisfactory explanations and unify legal thinking.

Delegates attending the conference were informed at the bridge point of the Bac Giang City People's Committee Hall.

He also requested that agencies, units and localities, immediately after the conference, continue to promote propaganda work, promptly disseminate the 2024 Land Law and detailed regulations and implementation instructions to cadres and people of all walks of life in appropriate forms.

The People's Committees at district and commune levels need to focus on training on the Land Law, proactively coordinate with the Department of Natural Resources and Environment and the Department of Justice to regularly organize training courses and provide guidance on the Land Law for officials and civil servants directly performing public duties and grassroots officials.

Local Party committees and authorities need to step up the settlement of administrative procedures, increase access to land for people and businesses in the spirit of applying the new law more openly than the old law. At the same time, strengthen inspection and strictly handle land violations to prevent the emergence of hot spots and complicated situations of political security and social order and safety related to the land sector.

With the province's viewpoint of not allowing existing issues and legal institutional problems to create bottlenecks, affecting the implementation of tasks and socio-economic development goals of the locality, comrade Mai Son requested the Department of Natural Resources and Environment to preside over and coordinate with the Department of Justice to set up a zalo group "New Land Law" to receive opinions and recommendations, focus on reviewing, synthesizing, and analyzing major difficulties, problems, and unclear points in the process of applying the Land Law and the accompanying Decrees, advise the Provincial People's Committee to report to the Government and ask for guidance from the Ministry of Natural Resources and Environment to have a basis for implementation.

At the conference, delegates listened to Reporter Nguyen Tu Hoang - Department of Planning and Land Resources Development (Ministry of Natural Resources and Environment) introduce the content of Decree 88/2024/ND-CP dated July 15, 2024 of the Government regulating compensation, support and resettlement when the State recovers land.

The reporter said that the regulation on land price for calculating land use fees when compensating with land with a different purpose than the type of land recovered for households and individuals currently using residential land or owning houses attached to land use rights is the land price determined according to the land price list at the time of approval of the compensation, support and resettlement plan.

The reporter emphasized that the Decree also clearly stipulates that in case of compensation by land lease with land rent paid in one lump sum for the entire lease term, the land price for calculating land rent is the specific land price decided by the People's Committee at the competent level at the time of approving the compensation, support and resettlement plan....

Reporter Le Van Binh - Deputy Director of the Department of Land, Ministry of Natural Resources and Environment introduced Decree 102/2024/ND-CP.

Introducing Decree 102/2024/ND-CP dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law, Reporter Le Van Binh - Deputy Director of the Department of Land (Ministry of Natural Resources and Environment) emphasized that one of the notable contents of this Decree is to focus on providing specific and detailed guidance on land recovery procedures due to violations of land law.

Accordingly, in case of land violations that require administrative sanctions, within 30 days from the date of receipt of the document from the agency or person with authority to sanction administrative violations and the recommendation to recover land due to the land user's continued violations, the competent land management agency shall submit it to the competent state management agency to recover land according to regulations.

For violations that do not require administrative sanctions, land recovery is carried out after the competent inspection and examination agency has concluded that land recovery is required. After receiving the documents and materials from the competent authority, within 30 days, the competent land management agency shall prepare a land recovery dossier and submit it to the People's Committee of the competent authority to recover the land...

At the conference, delegates also heard the Reporters present and introduce Decree 71/2024/ND-CP dated June 27, 2024 of the Government promulgating regulations on land prices; Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government regulating basic investigation, land registration, granting of Certificates of land use rights, ownership of assets attached to land and land information system; Decree No. 123/2024/ND-CP dated April 10, 2024 of the Government regulating sanctions for administrative violations in the field of land.

The conference was held to contribute to improving the quality of law enforcement, helping delegates correctly understand and apply the provisions of the 2024 Land Law. At the same time, it helps to properly handle related issues in the fields of state management of land, contributing to removing bottlenecks in land, promoting local socio-economic development./.
