Traffic police explain proposal to increase fines by 5 times for giving vehicles to unqualified people

Regarding the act of handing over a vehicle to an unqualified person, the drafting agency proposed to increase sanctions, attaching responsibility for this act to the person handing over the vehicle and the vehicle owner.

The Traffic Police Department of the Ministry of Public Security is consulting on the development and completion of a draft Decree regulating administrative sanctions for violations of traffic order and safety in the field of road traffic; and deduction and restoration of driving license points.

In this fourth draft, the drafting agency plans to increase penalties for some groups of violations related to traffic rule violations and many groups of violations that are direct causes of traffic accidents.

In one month, more than 450 parents and car owners in Hanoi were punished for giving their cars to unqualified drivers.

Notably, the latest draft proposes to increase administrative penalties for the act of handing over a vehicle to an unqualified person by 5 times, from the old fine of 4-6 million VND to the new fine of 28-30 million VND.

A representative of the Traffic Police Department explained that since October 1, authorities nationwide have been conducting a peak period of inspections and handling violations against students and parents; gatherings to race, weave, and disrupt public order...

During the implementation process, in addition to propaganda and warnings, traffic police also focused on handling violations such as: driving without a driver's license; not wearing a helmet; carrying more people than prescribed; not obeying traffic light signals...

"Especially focus on handling some behaviors such as handing over vehicles to unqualified drivers, handing over vehicles to young people who gather to disturb public order, driving erratically and weaving in and out of traffic," the Traffic Police Department emphasized.

After about a month of deployment, the task force in many localities recorded that a number of parents still did not pay attention to managing and educating their children, carelessly giving their children vehicles even though they knew their children were not qualified to drive.

As in Hanoi, from October 10 to 28, traffic police and other units handled over 7,600 cases of students violating traffic laws, temporarily impounding 3,495 vehicles of all kinds. Of these, 6,600 cases involved not wearing helmets and nearly 1,400 students were driving motorbikes when they were not qualified.

Notably, traffic police directly handled over 450 cases of parents and car owners handing over their cars to unqualified drivers. This is one of the direct causes of traffic accidents, gatherings of drivers weaving and swerving.

It is possible to prosecute the act of handing over a vehicle to an unqualified driver.

The Traffic Police Department found that the results of the campaign in the past peak month also correctly assessed the current situation of awareness, compliance with the law, use of means of transport, common violations of school-age children; and giving vehicles to people who are not qualified to drive them.

The act of handing over a vehicle to an unqualified driver poses a high risk of causing traffic accidents and illegal racing.

In addition, a number of young people do not really pay attention to learning to improve their awareness and skills in traffic safety. Many parents and vehicle owners also take lightly the compliance with traffic safety laws, even violating traffic safety regulations.

On that basis, the Traffic Police Department assesses that increasing the penalty for some intentional violations that cause traffic accidents such as running red lights, driving in the wrong direction, handing over the vehicle to unqualified people... is completely necessary, ensuring humanity and raising drivers' awareness, building a civilized traffic culture environment.

"Regarding the act of handing over a vehicle to an unqualified person, the drafting agency proposes to increase sanctions, attach responsibility for this act to the person handing over the vehicle, the vehicle owner, and especially resolutely handle criminal cases of handing over a vehicle that causes a traffic accident with consequences according to the provisions of the law," the Traffic Police Department emphasized.
