Are contract teachers entitled to maternity benefits?

Pursuant to the Law on Social Insurance No. 58/2014/QH13 dated November 20, 2014, Clause 2, Article 4, social insurance and voluntary social insurance regimes have the following regimes: Retirement; Death benefit.

Article 87 of the 2014 Law on Social Insurance stipulates: Employees specified in Clause 4, Article 2 of this Law shall pay monthly 22% of their monthly income chosen by the employee to the pension and death benefit fund; the monthly income used as the basis for social insurance payment shall be at least equal to the poverty line in rural areas and at most 20 times the basic salary.

Based on socio -economic development conditions and the State budget capacity in each period to determine the support level, support objects and implementation time of the policy to support social insurance contributions for employees participating in voluntary social insurance.

Employees may choose one of the following payment methods: Monthly; once every 3 months; once every 6 months; once every 12 months; One time for many years to come at a lower rate than the monthly payment or one time for the remaining years at a higher rate than the monthly payment as prescribed in this Article.

According to the above regulations, the voluntary social insurance contribution level is equal to 22% of the income level chosen by the individual. In which, the monthly income level used as the basis for contribution is at least equal to the poverty line for rural areas (1,500,000 VND/person/month) and at most equal to 20 times the basic salary, the current basic salary is 1,800,000 VND (equivalent to 36,000,000 VND/month).

According to the provisions of the Law on Social Insurance and documents under the Law on Social Insurance, there is currently no maternity regime for voluntary social insurance participants. You need to contact the social insurance agency where you participate in insurance to get a satisfactory answer.
