Prosecution and temporary detention of Director of Tomoken Company for producing millions of fake fire extinguishers

On October 4, the Investigation Police Agency, Phu Tho Provincial Police initiated a criminal case, prosecuted the accused, and issued an arrest warrant to detain Phan The Hoai, Director of Tomoken Vietnam Fire Prevention and Fighting Company Limited, for the act of "Producing and trading in counterfeit goods".

This company is located at Dai An Industrial Park, Tu Minh Ward, Hai Phong City.

On the same day, the investigation agency also prosecuted and temporarily detained Phan Bach Thong, Executive Director of Tomoken Vietnam Fire Prevention and Fighting Company Limited at Lot CN3, Cam Thinh Industrial Park, Cua Ong Ward, Quang Ninh Province, also on the above charges.

Through reconnaissance work and understanding the local situation, the Economic Police Department of Phu Tho Provincial Police discovered that in Phu Tho province, some types of portable fire extinguishers of 6kg and 8kg manufactured by Tomoken Vietnam Industrial Co., Ltd. were being sold with signs of "Manufacturing and trading counterfeit goods".

During the investigation, the Investigation Police Agency, Phu Tho Provincial Police determined that: Phan The Hoai, as the Director of the above 2 Companies, and his younger brother Phan Bach Thong agreed to purchase 6 types of raw materials including: Monoammonium Phosphate (MAP) powder; Ammonium Sulphate (SA) powder; Quatz (SiO2) powder; silica powder; Silicon essential oil; colorant powder and water to mix according to the % ratio without any basis or scientific basis to prove that the above mixture is fire extinguishing powder.

Among them are ingredients such as: Quatz powder has no fire-fighting effect but accounts for a large proportion (54%) in the mixing formula to reduce costs, reduce value and increase business profits.

During the operation, Phan The Hoai was the person who directly directed the business activities and assigned Phan Bach Thong to directly hold the chemical mixing formula consisting of the 6 above-mentioned ingredients; at the same time, he created a mixing instruction table for factory workers to mix and fill the chemical mixture into fire extinguishers and sell them to the market. All portable fire extinguishers were branded Tomoken.

Initially, the Investigation Police Agency of Phu Tho Provincial Police determined that from 2023 to present, Tomoken Quang Ninh Company has sold a total of 2,203,263 fire extinguishers of all kinds to the market with total sales of nearly 835 billion VND.

Of which, fire extinguishers (using chemical mixtures that Phan Bach Thong mixed himself) were more than 1.6 million with total sales of more than 527 billion VND (6kg and 8kg powder extinguishers were more than 850 thousand extinguishers, equivalent to nearly 296 billion VND).

The appraisal conclusion of the Institute of Criminal Science of the Ministry of Public Security determined: 16 samples of 6kg portable fire extinguishers and 20 samples of 8kg portable fire extinguishers, which were confiscated from this Company, were not effective in extinguishing Class B fires according to national technical regulations on fire prevention and fighting equipment.

Currently, the investigation agency continues to consolidate the records to handle the above subjects according to the provisions of law.
