Presenting the Report at the meeting, Mr. Phan Trung Tuan, Director of the Department of Local Government ( Ministry of Home Affairs ) said that the issuance of the Resolution aims to concretize the 2013 Constitution (amended and supplemented by a number of articles in Resolution No. 203/2025/QH15) and the Law on Organization of Local Government No. 72/2025/QH15; improve the efficiency, effectiveness and efficiency of the People's Councils at the provincial and communal levels in the context of implementing the 2-level local government model and strengthening decentralization and delegation to local governments at all levels.
Regarding the basic content of the Resolution, Mr. Phan Trung Tuan said that, regarding the number of Vice Chairmen, Deputy Heads, and full-time members of the Provincial People's Council Committees, based on Conclusion No. 187-KL/TW dated August 29, 2025 of the Politburo and the Secretariat, the draft Resolution stipulates that, regarding the number of Vice Chairmen of the Provincial People's Council, for provinces and cities implementing mergers and consolidations, cities implementing mergers and consolidations of 3 provincial-level administrative units (UDs) shall have no more than 4 Vice Chairmen of the People's Council; Cities implementing mergers and consolidations of 2 provincial-level UDs shall have no more than 3 Vice Chairmen of the People's Council; provinces implementing mergers and consolidations shall have no more than 3 Vice Chairmen of the People's Council.
For provinces and cities that do not merge or consolidate, there shall be no more than two Vice Chairmen of the People's Council. In case the Chairman of the Provincial People's Council is a full-time People's Council delegate, the number of Vice Chairmen of the Provincial People's Council shall be reduced by one person.
Regarding the number of Deputy Heads of the Provincial People's Council, for provinces and cities implementing mergers and consolidations, provinces and cities implementing mergers and consolidations of 3 provincial-level administrative units shall have no more than 4 Deputy Heads of the Board; provinces and cities implementing mergers and consolidations of 2 provincial-level administrative units shall have no more than 3 Deputy Heads of the Board.
In case the Ethnic Committee is established on the basis of the existing Ethnic Committees of 3 provinces and cities before the merger or consolidation, there will be no more than 4 Deputy Heads of the Committee; in case the Ethnic Committee is established on the basis of the existing Ethnic Committees of 2 provinces and cities before the merger or consolidation, there will be no more than 3 Deputy Heads of the Committee; in case the Ethnic Committee is established on the basis of the existing Ethnic Committee of 1 province or city before the merger or consolidation, there will be no more than 2 Deputy Heads of the Committee.
For provinces and cities that do not merge or consolidate, each Committee shall have no more than 2 Deputy Heads of Committee. In case the Head of the Provincial People's Council is a full-time People's Council delegate, the number of Deputy Heads of Committee shall be reduced by 1 person.
Regarding the number of members of the Provincial People's Council Committees, each Committee shall have no more than 1 member who is a full-time People's Council delegate. The number of Vice Chairmen of the People's Council, Vice Heads of Committees of the People's Council and members of Committees of the Hanoi People's Council who are full-time People's Council delegates shall comply with the provisions of the Capital Law. Regarding the number of Vice Chairmen and Vice Heads of Committees of the Commune-level People's Council, the draft Resolution stipulates that the commune level shall have 1 Vice Chairman of the People's Council. Each Committee of the Commune-level People's Council shall have an average of 2 Vice Heads of Committees.
Based on the scale of natural area, population, classification of administrative units, classification of urban areas, economic scale, practical situation of the locality and orientation of the Standing Committee of the Provincial Party Committee, City Party Committee, the Standing Committee of the Provincial People's Council shall specifically decide the number of Deputy Heads of the People's Council at each administrative unit at the commune level, ensuring that the total number of Deputy Heads of the People's Council at the commune level of the province or city does not exceed the total number calculated according to the average framework prescribed above.
Continue to review specific and logical security regulations
At the meeting, opinions in the Appraisal Council expressed agreement on the political and legal basis for drafting the Resolution.
The delegates agreed with the issuance of the Resolution to create a synchronous and unified legal basis for the organization and operation of the People's Councils at the provincial and communal levels when operating the two-level local government in accordance with the provisions of the Constitution and the Law on Organization of Local Government; meeting the requirements of arranging the number of full-time People's Council delegates at the provincial and communal levels to ensure compliance with the policy of promoting decentralization and decentralization and the local practical situation, contributing to improving the effectiveness and efficiency of the People's Councils at all levels in the new development period.
Highly appreciating the draft submission and draft Resolution, the representative of the National Assembly's Committee on Law and Justice commented that the draft Resolution has provisions ensuring flexibility, in line with the requirements of promoting decentralization according to the motto "locality decides, locality does, locality is responsible".
Concluding the meeting, Deputy Minister of Justice Dang Hoang Oanh, Chairman of the Appraisal Council, said that the contents of the draft Resolution ensure constitutionality, legality, compatibility with relevant international treaties to which Vietnam is a member, ensuring national defense, security, and ensuring requirements on financial resources, human resources, etc.
The Deputy Minister requested the Drafting Agency to continue reviewing the provisions on decentralization in the draft Resolution to ensure consistency with the principles and regulations on decentralization and delegation of power in the Law on Organization of the Government and the Law on Organization of Local Government.
Along with that, it is necessary to review the provisions in the main content groups of the draft Law and the scope of regulation to ensure specificity and logic. Agreeing with the construction of the Resolution according to the shortened procedure, the Deputy Minister requested the drafting agency to review and complete the draft Resolution dossier to ensure compliance with the provisions of the Law on Promulgation of Legal Documents. The draft Resolution is eligible to be submitted to the Government after receiving the opinions of the members of the Appraisal Council.
Also on the afternoon of September 29, Deputy Minister Dang Hoang Oanh chaired a meeting of the Council for Appraisal of the draft Resolution of the National Assembly Standing Committee stipulating the standards and conditions for establishing the Ethnic Council of the Provincial People's Council. At the meeting, opinions in the Appraisal Council expressed their approval for the issuance of the Resolution to concretize the 2013 Constitution (amended) and the Law on Organization of Local Government 2025; ensuring the unity and synchronization of the legal system, in accordance with the 2-level local government model.
The Draft Resolution supplements the standards and conditions for establishing the Ethnic Committee of the People's Council of a centrally-run city; abolishes the regulations on establishing the Ethnic Committee of the People's Council at the district level. At the same time, inherits the standards prescribed in Resolution No. 1130/2016/UBTVQH13 because these standards are still suitable for practice and provincial-level administrative units have established Ethnic Committees in the new situation.
