Regulations on Land Price Adjustment Coefficient in 2024

Accordingly, land prices in Lai Chau province are regulated in points a, b, c and d, Clause 4, Article 114, Clause 2, Article 172 and Clause 3, Article 189 of the Land Law, determining land prices to serve as starting prices for land use rights auctions when the State allocates land with land use fees, leases land with one-time land fee collection for the entire lease term, and the land plot or land area of the project has a value (calculated according to land prices in the land price table) of less than 10 billion VND.

Determine land price as the basis for calculating land rent when the State leases land and collects annual land rent, but must re-determine land rent unit price to adjust for the next cycle. Determine land price as the basis for determining starting price for land use rights auction when the State leases land and collects annual land rent.

In the case of land use fee calculation area of land plots or land areas with value (calculated according to land price in the Land Price List) under 10 billion VND, the land use fee shall be determined in the following cases:

Organizations that are allocated land by the State with land use fees collected without going through the form of land use rights auction, land use rights recognition, and permission to change land use purposes; Households and individuals that are allocated land by the State with land use fees collected without going through the form of land use rights auction; Households and individuals that are recognized by the State with land use rights, and permission to change land use purposes for residential land area exceeding the limit.

In case of regulations on land use fee collection, land rent collection, water surface rent collection: Determining the land rent unit price for annual land rent payment in case of land lease for commercial business purposes, services, real estate, mineral exploitation; determining the land rent unit price for one-time payment for the entire lease term without auction; determining the land rent unit price when switching from land lease with annual land rent payment to land lease with one-time land rent payment for the entire lease term according to regulations in Clause 2, Article 172 of the Land Law; determining the land rent unit price when receiving the transfer of assets attached to leased land according to regulations in Clause 3, Article 189 of the Land Law; determining the land rent unit price for annual land rent payment and the land rent unit price for one-time land rent payment for the entire lease term when equitizing state-owned enterprises is applied in case the land rent area of the land plot or land area is calculated with a value (calculated according to the land price in the Land Price Table) of less than 10 billion VND.

Determine the land rental price to pay annual land rent for the next stable period for land plots or land areas leased by the State for commercial, service, real estate, and mineral exploitation purposes with a value (calculated according to the land price in the Land Price List) of 10 billion VND or more. Determine the land rental price to pay annual land rent (excluding cases of land lease for commercial, service, real estate, and mineral exploitation purposes). Determine the starting price in the auction of land use rights for lease in the form of land lease, paying annual land rent.

This Decision replaces Decision No. 62/2022/QD-UBND dated December 31, 2022 of the People's Committee of Lai Chau province regulating the land price adjustment coefficient in 2023 in Lai Chau province.
