Vietnam Social Security (VSS) said that Decision 863 of the Ministry of Home Affairs announced new administrative procedures, abolishing a number of procedures in the field of social insurance, in which regulations on procedures for receiving sick leave benefits are specifically guided.

Procedures for receiving sick leave benefits
Accordingly, employees are responsible for submitting the required documents to the employer. The deadline for submitting the documents is 45 days from the date of returning to work.
Within 7 working days from the date of receiving complete documents from the employee, the employer is responsible for making a list of employees taking sick leave with the documents submitted to the Social Insurance agency.
Within 7 working days from the date of receiving the complete documents as prescribed from the employer, the Social Insurance agency is responsible for resolving the matter. In case of non-resolution, a written response must be given stating the reasons.
The procedure can be done in person, online or by post.
The file includes hospital discharge papers, medical record summary, social insurance leave certificate, documents proving inpatient or outpatient treatment, and leave list prepared by the enterprise.
In case of medical examination and treatment abroad, the documents must have a notarized Vietnamese translation and consular legalization unless otherwise stipulated by international treaties. The maximum processing time is 7 working days.
The subjects of application are Vietnamese employees, foreign employees working in Vietnam and employers. The result is a list of sick leave benefits, no fee is collected.
Regulations on sick leave benefits for parents when their children are sick
Employees participating in social insurance are entitled to benefits when treating illnesses or accidents outside the scope of work; accidents on the way to and from work according to a reasonable route; treatment of relapses due to work-related accidents; occupational diseases; organ transplantation or caring for sick children under 7 years old.

The maximum time off for employees with children under 3 years old to take care of sick children (for each child) is 20 days/year; children from 3 years old to under 7 years old are entitled to a maximum of 15 days/year.
If both parents participate in compulsory social insurance, each person can take leave but not exceeding the maximum time prescribed for each child. In case of two or more children under 7 years old who are sick, the time to enjoy the regime is calculated based on the actual number of days off to take care of the children.
However, employees are not entitled to benefits if they self-injure, use illegal drugs, are undergoing initial treatment for a work accident or occupational disease, or are on other leave such as maternity leave or paid leave.
