Regulations on economic and technical characteristics of on-demand services related to notarization in Bac Ninh province

BAC NINH - Vice Chairman of the Provincial People's Committee Pham Van Thinh has just signed and issued Decision No. 05/2025/QD-UBND regulating the economic and technical characteristics of on-demand services related to notarization in the province.

The Decision regulates the economic and technical characteristics of on-demand services related to notarization in the province, including: Drafting, checking, and editing contracts and transactions; typing documents; photocopying documents and papers; translating documents and papers. The Decision applies to notarization organizations in the province; people requesting notarization and other related organizations and individuals.

According to the Decision, the economic and technical characteristics of drafting contracts and transactions are that notary organizations create draft contracts and transactions on paper or electronic data files to record agreements and terms between parties participating in the transaction to ensure compliance with the law and not contrary to social ethics.

Checking and editing contracts and transactions is the act of a notary public organization checking draft contracts and transactions on paper documents or electronic data files drafted by the person requesting notarization; editing the terms in the draft contract and transaction to ensure that the draft contract and transaction is in accordance with the law and not contrary to social ethics at the request of the person requesting notarization.

Contracts and transactions related to notarization include: Business, commercial and investment contracts; Contracts related to the exercise of land users' rights according to the provisions of the Land Law; Contracts for transfer, donation, mortgage, capital contribution in the form of land use rights, land use rights and assets attached to land; Contracts for lease, sublease of land use rights, land use rights and assets attached to land, contracts for conversion of agricultural land use rights; contracts for transfer, capital contribution in the form of land use rights, land use rights and assets attached to land, assets attached to land in which one party or parties participating in the transaction is an organization conducting real estate business activities; Documents on inheritance of land use rights, land use rights and assets attached to land; Contracts related to the exercise of rights of individuals and organizations to movable property; Authorization documents; Documents amending, supplementing, canceling contracts and transactions; Other types of contracts and transactions.

The Decision also stipulates the economic and technical characteristics of typing documents related to notarization, which is the act of a notary organization entering existing documents provided by the person requesting notarization or transmitting the will into text or electronic data to create documents related to notarization as prescribed in Clause 3, Article 3 of this Decision.

The economic and technical characteristics of photocopying documents and papers related to notarization are the organization of notarization practice photocopying documents and papers related to notarization by photocopying/scanning from paper to paper or from paper to electronic data files, creating copies that are identical to the originals. Photocopies of documents and papers are calculated by page of the original document. Documents and papers required to be copied must be documents related to notarization of contracts and transactions in Clause 3, Article 3 of this Decision.

The economic and technical characteristics of document and text translation are that the translation collaborator of a notary organization transmits information on documents and texts from Vietnamese to a foreign language or from a foreign language to Vietnamese without changing the meaning and content of the original document.

The Department of Justice shall preside over and coordinate with relevant agencies and units to guide, inspect, and urge the implementation of the Decision. The Notary Association and notary practice organizations shall disseminate, thoroughly understand, and implement the contents of the Decision to their members, notaries, and employees.
