Accordingly, regarding the regulations on funding for educational institutions under Circular 16, the Department of Education and Training of Ho Chi Minh City requests that educational institutions not authorize the parent representative committee to preside over the organization of fundraising. Do not take advantage of sponsorship to force parents to contribute and do not consider fundraising as a condition for providing educational and training services.
The plan to mobilize funding must be approved by the School Council and Pedagogical Council before mobilizing funding and reported to the direct superior management agency; implementation can only be carried out after receiving approval from the Department of Education and Training of Ho Chi Minh City.
At the same time, it is recommended that schools not focus on mobilizing parents of students whose children are studying at the school, but expand the target of mobilizing sponsorship, such as: Enterprises, corporations, economic organizations at home and abroad; agencies, socio -political organizations, non-governmental organizations; individuals, and philanthropists with a spirit of volunteering.
Financial sponsorships must be approved through a sponsorship receipt with a list of signatures from parents of students, and a receipt must be created, a detailed accounting book opened to separately track the sponsored amount and recorded in the accounting system according to regulations.
Regarding fundraising for facilities and equipment, the Department of Education and Training of Ho Chi Minh City requires schools not to fund purchases and repair projects that educational institutions can budget for, use state capital, career revenue, and career development funds for annual purchases and repairs according to regulations.
The plan for approval must clearly define the purpose of the proposed fundraising. The fundraising content clearly states the fundraising target for each category.
Sponsors are encouraged to organize the investment in construction, purchase equipment and complete installation to hand over to educational institutions according to the agreement and instructions of the educational institutions.
For donations of material items with long-term use value or special characteristics, the receiving unit must conduct an appraisal, make a record, and report to the department for consideration and approval before putting them into use, and be responsible for the suitability, safety, and effectiveness of the donated material items. For projects affecting the property structure of the educational institution, the unit must attach construction drawings.
The head of the educational institution is responsible before the law for mobilizing, receiving, managing and using sponsorships.
It is strictly forbidden to use parent-student operating funds to purchase machinery, equipment, and teaching aids for schools and classrooms.
Regarding the implementation of operating expenses of the parent-teacher association, the Department of Education and Training of Ho Chi Minh City recommends that the regulations in Circular No. 55/2011 be strictly implemented. It is strictly forbidden to take advantage of the name of the parent-teacher association to collect fees other than those specified in Circular No. 55.
The Department of Education and Training of Ho Chi Minh City emphasized: The operating budget of the parents' representative committee is managed and used by the parents' representative committee and only serves the direct activities of the parents' representative committee.
Do not use the funds of the parent-teacher association for the following purposes: “Protecting school facilities, ensuring school security, supervising students' vehicles, cleaning classrooms, cleaning the school, rewarding administrators, teachers, and school staff, purchasing machinery, equipment, and teaching aids for schools, classes, or for administrators, teachers, and school staff, supporting management work, organizing teaching and educational activities, repairing, upgrading, and constructing new school facilities.”
The principal agrees with the head of the school's parents' representative board to decide on the plan for using the school's parents' representative board funds and only uses them after the entire school's parents' representative board has agreed.
The Department of Education and Training of Ho Chi Minh City requested the People's Committees of wards, communes, and special zones to be responsible for organizing the implementation of regulations on funding for preschools, primary and secondary schools.
At the same time, it is responsible for implementing and guiding the units in charge under its management authority to properly implement the provisions of Circular No. 16 and Circular No. 55.
