Prime Minister: Avoid the situation where subordinates ask superiors for anything

At the Government's special meeting on law-making in September 2024, the Prime Minister requested Ministers and heads of sectors to uphold the spirit of serving the country and the people, daring to think, daring to do, and daring to take responsibility.

On the morning of September 23, Prime Minister Pham Minh Chinh chaired the Government's special meeting on law making in September 2024 to review and give opinions on four contents: Draft Law on amending and supplementing a number of articles of the Law on Health Insurance; Draft Law on Data; Proposal to develop a Law on Personal Data Protection; Proposal to develop a Law on Lawyers (amended).

This is the second specialized law-making session in September and the 10th specialized law-making session in 2024 of the Government.

Attending the meeting were Deputy Prime Ministers Tran Hong Ha and Le Thanh Long; Ministers, Heads of ministerial-level agencies and Government agencies; leaders of relevant ministries, branches and agencies.

Speaking at the opening of the meeting, the Prime Minister pointed out that building and perfecting institutions and laws is one of three strategic breakthroughs because institutions are both a resource and a driving force for development.

According to the Prime Minister, at the 10th Central Conference, the Central Committee discussed the need to further promote the building and improvement of institutions.

Along with practical requirements, one of the reasons why officials still shirk responsibility, are afraid of responsibility, and are afraid of making mistakes is due to the system. Therefore, it is necessary to remove the system so that civil servants dare to do things and are not afraid of making mistakes. The Central Committee also agreed to strengthen human resources, facilities, and treatment for those involved in making the system.

The Prime Minister clearly stated the spirit of the 10th Central Conference of the 13th tenure is to promote decentralization and delegation of power; avoid having lower levels "ask" higher levels for anything, but must base it on regulations. We are building a socialist rule-of-law state of the people, by the people, for the people; based on the regulations of the Politburo and the Secretariat to do things; no matter how small the problem is, it must be submitted to the Central Committee for decision; requesting Ministers, leaders of ministries, branches, and heads of agencies to thoroughly grasp this spirit to resolve problems, promote stronger decentralization and delegation of power, go hand in hand with resource allocation, and at the same time improve responsibility and implementation capacity from lower levels.

The Prime Minister said that in his opening speech at the 10th Central Conference, General Secretary and President To Lam clearly stated the spirit of "locality decides, locality acts, locality takes responsibility;" the Central Government, the National Assembly, and the Government only issue mechanisms, guidelines, and design monitoring and inspection tools.

Ministers and heads of sectors should only deal with strategic issues, planning, program orientation, and important development policies for the country. They should not get caught up in specific issues that can easily create a "request-grant" environment, avoiding negativity.

The Central budget only invests in inter-regional, national and international programs and projects; provincial-level programs and projects are decided by the province or city; administrative reform must be promoted right in the law-making process, reflected in the provisions of the Law, Circulars and Decrees.

Expressing dissatisfaction with a number of Decrees that assigned some ministries and branches to complete early but have not been completed yet, the Prime Minister requested that Ministers and heads of branches must uphold the spirit of serving the country and the people, daring to think, daring to do, and daring to take responsibility.

Claiming that internal administrative procedures are still cumbersome, the Prime Minister requested that if there is no response from Government members within the deadline, it must be considered as consent. “The Party’s leadership principle is that the minority obeys the majority,” the Prime Minister noted.

In order to avoid the situation where the more laws are issued, the more difficult it is to implement, the Prime Minister requested to build laws to strengthen management but must create a development environment, not tighten and narrow; when amending laws, we must be bold, and remove any obstacles; overlapping laws are very difficult to implement and do not encourage innovation.

Prime Minister Pham Minh Chinh requested members of the Government, Ministers, and Heads of sectors to directly direct the law-making; prioritize human resources, facilities, and finances for this work; uphold the spirit of responsibility, focus on democracy, discipline, and administrative discipline; if anyone is afraid of responsibility, "stand aside."

When responding, ministries and branches must be specific, not general, and the assignment must be "clear about people, work, responsibilities, implementation time, effectiveness, and products", not shirk responsibility, and first of all, serve well the 8th Session of the 15th National Assembly./.
