According to regulations, land division and land consolidation must ensure the principles and conditions prescribed by the Land Law (in Article 146 and Clause 1, Clause 2, Clause 3, Article 220, Land Law No. 31/2024/QH15).

In the case of land division in the case of resettlement land allocation, it is only carried out after the decision to adjust the planning is approved by the competent authority.

Regarding the area and minimum size after being divided, the People's Committee of Binh Dinh province stipulates that the urban residential land plot after being divided must have a minimum area of 40 m2, the width (frontage) and length (depth) of the land plot must be at least 3 m.

For non -agricultural land, the minimum area for separation of surplus non-agricultural land that is not residential land (not part of an investment project) is 100 m2, with width (frontage) and length of 5m or more.

For agricultural land, the People's Committee of Binh Dinh province stipulates that the area of land for growing annual crops and salt-making land is 500 m2, with width and length from 5 m or more; land for growing perennial crops and aquaculture land is 1,000 m2, with width and length from 10 m or more; production forest land is 5,000 m2, with width and length from 50 m or more...

In addition, regarding land consolidation, the People's Committee of Binh Dinh province mentioned, "now when proposing to consolidate land plots, the difference in land use fees and land registration tax must be calculated based on the land price with the highest frontage position (except in cases where the land plot has transferred land use rights to another land user)".

This requirement applies to the case where a land plot is located adjacent to two or more roads and has been permitted by a competent State agency to be divided into new plots of land, with the frontage of each separated plot of land adjacent to a road with different land prices and the purpose of use has been changed to residential land, land use fees and land registration tax have been paid.
