Chairman of Ho Chi Minh City People's Committee directs handling of surplus constructions and headquarters after merger

On September 29, Vice Chairman of the Ho Chi Minh City People's Committee Bui Minh Thanh issued a document conveying the opinion of the Chairman of the Ho Chi Minh City People's Committee on the implementation of statistics and reports on the area of ​​houses, land, constructions, and headquarters directly managed by the State that are not in use or are not used effectively, and to combat waste in the Ho Chi Minh City area.

Accordingly, the Chairman of the People's Committee of Ho Chi Minh City directed the Chairmen of the People's Committees of wards, communes and special zones (commune level) to carry out a number of tasks as follows: For surplus houses and land due to the rearrangement of administrative boundaries, based on urban and rural construction planning, land use planning, and local land use needs, report and propose plans to rearrange and handle houses and land in accordance with legal regulations. On that basis, report to the Department of Finance to preside over, coordinate with Departments and branches to advise and propose to the People's Committee of Ho Chi Minh City for consideration and decision.

For houses and lands with disputes, complaints or encroachment by people, it is necessary to resolve disputes and complaints completely and recover encroached or occupied land for exploitation and use.

For small, narrow, and interspersed plots of land that do not meet the minimum conditions and area for land division, the legal provisions shall be used for public purposes to serve the needs of the community or to allocate or lease land to adjacent land users, collect land use fees and land rents and pay them to the State budget.

In addition, for houses and land managed by the City Land Fund Development Center, the Chairman of the Ho Chi Minh City People's Committee assigned the City Land Fund Development Center to propose suitable land use plans or make short-term lease proposals according to the procedures for short-term lease of land funds and assets attached to land in accordance with regulations.

The Chairman of the Ho Chi Minh City People's Committee assigned the Department of Agriculture and Environment, the Department of Finance, the Department of Construction and relevant departments, branches, agencies and units to coordinate to guide the People's Committees at the commune level and the City Land Fund Development Center to use houses and land, ensuring the economical and effective use of land, in accordance with urban and rural construction planning, land use planning, and in accordance with legal regulations.
