The Ministry of Home Affairs said that according to Law No. 98/2025/QH15 amending and supplementing a number of articles of 11 laws on military and national defense (effective from July 1, 2025) amending and supplementing a number of articles of the Law on Militia and Self-Defense Forces No. 48/2019/QH14, the Commander, Deputy Commander and Assistant of the Commune-level Military Command are civil servants.
To carry out the recruitment and salary arrangement for civil servants who are Commanders, Deputy Commanders, and Assistants of the Commune-level Military Command in accordance with the provisions of the law on civil servants and the law on militia and self-defense forces, after consulting with relevant agencies, while the competent authority has not yet issued a separate adjustment document for Commanders, Deputy Commanders, and Assistants of the Commune-level Military Command, the Ministry of Home Affairs requests the People's Committees of provinces and centrally-run cities to unify the implementation according to the instructions.
Specifically, regarding job positions, Commander, Deputy Commander, Assistant of Commune-level Military Command: Implement according to the direction in Official Dispatch No. 7415/BNV-CCVC dated August 31, 2025 of the Ministry of Home Affairs.
Regarding recruitment, according to Clause 9, Article 10 of Law No. 98/2025/QH15, the Commander, Deputy Commander, and Assistant to the Commune Military Command are civil servants. Accordingly, recruitment in these cases is carried out in accordance with the provisions of the Law on Cadres and Civil Servants No. 80/2025/QH15 and Decree No. 170/2025/ND-CP, except for those who are currently cadres and civil servants.
The authority to appoint the Commander, Deputy Commander, and Assistant of the Commune-level Military Command; the standards on training qualifications and duties of the Commander, Deputy Commander, and Assistant of the Commune-level Military Command shall comply with the provisions of the Law on Militia and Self-Defense Forces No. 48/2019/QH14 (amending and supplementing a number of articles of Law No. 98/2025/QH15), the Government's Decree and the Ministry of National Defense 's guidance on implementing the Law on Militia and Self-Defense Forces; the number of Deputy Commanders and Assistants of the Commune-level Military Command shall comply with the provisions of Clause 2, Article 5 of Decree No. 220/2025/ND-CP.
Principles of personnel arrangement
According to the Ministry of Home Affairs, from July 1, 2025, when implementing the organization of two-level local government and implementing new regulations of the Law on Cadres and Civil Servants 2025, the Law on Militia and Self-Defense Forces 2019 (amending and supplementing a number of articles in Law No. 98/2025/QH15), the arrangement of positions of Commander, Deputy Commander, and Assistant to the Commune-level Military Command (new).
In the case of being the Commander of the Commune-level Military Command (old) who is a commune-level civil servant according to the provisions of the Law on Cadres and Civil Servants 2008 (amended and supplemented in 2019), when being considered and arranged for the position of Commander, Deputy Commander, Assistant of the Commune-level Military Command at the Commune-level Military Command (new), he/she will be converted into a civil servant according to the provisions of the Law on Cadres and Civil Servants 20254 if he/she meets the standards on training level as prescribed in Article 26 of the Law on Militia and Self-Defense Forces 2019 (amended and supplemented in Clause 13, Article 10 of Law No. 98/2025/QH15).
In case of being another cadre or civil servant expected to be assigned to the position of Commander, Deputy Commander, Assistant of the Military Command at the commune level (new), it is not necessary to carry out the recruitment and admission process into civil service according to the provisions of the Law on Cadres and Civil Servants 2025 and Decree No. 170/2025/ND-CP but must meet the standards on training level as prescribed in Article 26 of the Law on Militia and Self-Defense Forces 2019 (amended and supplemented in Clause 13, Article 10 of Law No. 98/2025/QH15).
Cases that are not cadres or civil servants and are expected to be assigned to the positions of Commander, Deputy Commander, or Assistant of the Military Command at the commune level (new) must follow the recruitment and admission process into civil service according to the provisions of the Law on Cadres and Civil Servants 2025 and Decree No. 170/2025/ND-CP.
On that basis, the consideration and appointment of the Commander, Deputy Commander, and Assistant to the Commune-level Military Command (new) shall be carried out in accordance with the provisions of the 2019 Law on Militia and Self-Defense Forces (amended and supplemented by Law No. 98/2025/QH15), the Government's Decree and the guidance of the Ministry of National Defense on the implementation of the Law on Militia and Self-Defense Forces. The standards on training qualifications are prescribed in Article 26 of the 2019 Law on Militia and Self-Defense Forces (amended and supplemented by Clause 13, Article 10 of Law No. 98/2025/QH15).
Regarding salary classification for Commanders, Deputy Commanders, and Assistants of the Commune-level Military Command (new), in cases where salaries are currently classified according to the professional and technical salary scale of civil servants and public employees prescribed in Decree No. 204/2004/ND-CP, they will continue to receive salaries according to the classified ranks and grades.
In case of salary being arranged according to the salary table of military ranks of people's army officers; officers, non-commissioned officers of people's police and cryptography or salary being arranged according to the salary table of professional soldiers of people's army and technical specialists of people's police or according to the salary tables for people doing cryptography work, then implement accordingly for each case according to the instructions in Clause 6, Clause 7, Section III of Circular No. 79/2005/TT-BNV.
In cases not covered by points a and b of this clause, the calculation method in point a, clause 10 of Circular No. 79/2005/TT-BNV shall apply.
Accordingly, based on the working time in accordance with the provisions of law in accordance with the requirements on professional qualifications of the position of Commander, Deputy Commander, Assistant to the Military Command at the commune level (new), having paid compulsory social insurance (if not continuously and not yet received one-time social insurance benefits, it will be accumulated), classified into the salary grade in the category of specialist - civil servant type A1 (if having university degree) or civil servant type A0 (if having college degree) prescribed in the Professional and technical salary table for cadres and civil servants in state agencies (Table 2) issued with Decree No. 204/2004/ND-CP according to the principle: From level 1, every 3 years (full 36 months) will be classified up 01 salary grade; After converting time to rank in the salary scale in the civil service, if there are less than 36 months, these months will be counted as the time to consider raising the salary scale next time or considering receiving seniority allowance beyond the framework (if any).
