Starting from January 1, 2025, the Law on Road Traffic Safety and Decree 168/2024/ND-CP on administrative sanctions for violations in the field of traffic safety will take effect. Accordingly, violators may be subject to administrative sanctions at levels much higher than before.
Required documents when riding a motorbike on the road
Article 56 of the Law on Road Traffic Safety, which officially took effect from January 1, 2025, stipulates the following conditions for people participating in traffic by motorbike:
- Drivers participating in road traffic must be of age and in good health as prescribed by law; have a valid driving license with points remaining, appropriate to the type of vehicle being driven, issued by a competent authority, except for motorbike drivers specified in Clause 4, Article 56 of the Law on Road Traffic Order and Safety 2024. When participating in road traffic, drivers must carry the following documents:
+ Vehicle registration certificate or certified copy of vehicle registration certificate with original confirmation documents from a credit institution or foreign bank branch that is still valid in case the vehicle is mortgaged at a credit institution or foreign bank branch;
+ Driving license appropriate to the type of vehicle being driven;
- Drivers of specialized motorbikes participating in road traffic must be of the age and health prescribed by law; have a license or certificate to operate specialized motorbikes appropriate to the type of specialized motorbike being driven; have a valid driving license with points remaining or a certificate of training in road traffic law. When participating in road traffic, drivers of specialized motorbikes must carry the following documents:
+ Vehicle registration certificate or certified copy of vehicle registration certificate with original valid receipt from credit institution or foreign bank branch in case the vehicle is mortgaged at credit institution or foreign bank branch;
+ License or certificate to drive specialized motorbikes;
+ Driver's license or certificate of training in road traffic law;
+ Certificate of technical safety and environmental protection inspection for specialized motorbikes according to the provisions of law;
+ Certificate of compulsory civil liability insurance as prescribed by law.
- In case the documents specified in Clause 1 and Clause 2, Article 56 of the Law on Road Traffic Order and Safety 2024 have been integrated into the electronic identification account, the presentation and inspection can be done through the electronic identification account.
- Motorbike drivers participating in road traffic must understand road traffic rules, have vehicle control skills; meet age and health requirements as prescribed in Point a, Clause 1 and Clause 2, Article 59 of the Law on Road Traffic Order and Safety 2024.
So when riding a motorbike on the street, people must especially remember to bring vehicle registration, driver's license appropriate to the type of vehicle they are driving, and compulsory civil liability insurance.
What is the penalty for not carrying sufficient documents?
Decree 168/2024/ND-CP on administrative sanctions for violations in the field of traffic order takes effect from January 1, 2025.
Fine for not carrying mandatory insurance and vehicle registration
- A fine of 200,000 VND to 300,000 VND for one of the following violations:
+ Drivers of motorbikes, mopeds, motorbike-like vehicles and motorbike-like vehicles for transport business do not carry a valid certificate of compulsory civil liability insurance for motor vehicle owners;
+ Drivers of motorbikes, mopeds, motorbike-like vehicles and motorbike-like vehicles do not have a valid certificate of compulsory civil liability insurance for motor vehicle owners;
+ Drivers of motorbikes, mopeds, motorbike-like vehicles and motorbike-like vehicles for transport business do not carry the vehicle registration certificate (or a certified copy of the vehicle registration certificate accompanied by the original receipt of the credit institution or foreign bank branch in case the credit institution or foreign bank branch holds the original vehicle registration certificate);
Fine for not carrying or having a valid driver's license
- A fine of between VND 2,000,000 and VND 4,000,000 shall be imposed on drivers of two-wheeled motorbikes with a cylinder capacity of up to 125 cm3 or an electric motor capacity of up to 11 kW and similar vehicles committing one of the following violations:
+ Not having a driving license or using a driving license that has had all points deducted or using a driving license not issued by a competent authority, an erased driving license, an invalid driving license, a driving license that is not suitable for the type of vehicle being driven;
- A fine of between VND 6,000,000 and VND 8,000,000 shall be imposed on drivers of two-wheeled motorbikes with a cylinder capacity of over 125 cm3 or with an electric motor capacity of over 11 kW, or three-wheeled motorbikes who commit one of the following violations:
+ Having a driving license but not suitable for the type of vehicle being driven;
+ Not having a driving license or using a driving license that has had all points deducted, a driving license not issued by a competent authority, an erased driving license, or an invalid driving license;
- Fine from 200,000 VND to 300,000 VND for the following acts: Drivers of motorbikes and similar vehicles for transport business do not carry a driver's license, except for violations specified in Point b, Clause 5, Point c, Clause 7 of this Article.
- A fine of 400,000 to 600,000 VND shall be imposed on drivers of specialized motorbikes who do not have a certificate of compulsory civil liability insurance as prescribed by law.
- A fine of between VND 4,000,000 and VND 6,000,000 shall be imposed on a person driving a specialized motorbike without a license (or certificate) to drive a specialized motorbike, without a driving license (or using a driving license that has had all points deducted, a driving license not issued by a competent authority, an erased driving license, an invalid driving license) or without a certificate of training in road traffic law.
