Teachers are not paid for teaching more than 200 extra lessons per school year.

The Ministry of Education and Training stipulates that the total number of extra teaching hours in a school year for each teacher to be calculated for overtime pay is no more than 200 hours.

On September 23, the Ministry of Education and Training issued Circular 21 regulating the regime and salary for overtime teaching for teachers in public educational institutions. The Circular takes effect from the date of signing.

The Ministry of Education and Training regulates the total number of hours and salaries for extra teaching of teachers in public educational institutions.

Accordingly, the salary of 1 month used as the basis for calculating overtime pay for teachers includes: salary calculated according to salary coefficient (or according to job position), leadership position allowance (if any), salary allowances and reserve difference coefficient (if any).

The total number of extra teaching hours in a school year of each teacher calculated to pay for extra teaching hours is not more than 200 hours.

In case the total number of extra teaching periods in a school year of a teacher exceeds 200 periods due to the subject not being able to arrange enough teachers to teach, the head of the educational institution must notify the competent authority in writing.

The total number of extra teaching periods in a school year of all teachers must not be higher than the maximum total number of extra teaching periods in a school year of the educational institution.

In case the total number of extra teaching periods in a school year of all teachers in an educational institution is higher than the maximum total number of extra teaching periods in a school year of the educational institution due to a subject that cannot be arranged with enough teachers to teach, the head of the educational institution must notify in writing the educational management agency according to its management authority.

Tasks that have received remuneration or allowances cannot be converted into teaching hours or have their teaching hours reduced to calculate overtime pay, unless otherwise provided by law.

The time for paying overtime pay to teachers is after the end of the school year. In case a teacher retires, quits, is transferred, the payment of overtime pay is made at the time of the decision on retirement, quits, is transferred, or transferred by the competent authority.

The time when a teacher does not directly participate in teaching but is counted as completing the required number of teaching periods according to the prescribed norms and is included in the total number of teaching periods in the school year of the teacher, including: the time when the teacher performs other tasks assigned or mobilized by the educational institution or competent authority (except for tasks for which remuneration has been received).

The time teachers are sent by competent authorities for training and development without directly participating in teaching; the time is calculated as completing the required number of teaching periods according to the provisions of law.

How is the salary for tutoring regulated?

According to Circular 21, the total number of extra teaching periods in a school year for teachers is determined: number of extra teaching periods of teachers/school year = (total number of actual teaching periods/school year) - (standard teaching periods/school year).

In which, the total number of actual teaching periods/school year includes: actual number of teaching periods/school year; converted teaching periods/school year according to regulations (if any); additional teaching periods/school year according to regulations (if any); reduced teaching periods/school year according to regulations (if any); and teaching periods counted into the number of sufficient teaching periods/school year according to regulations (if any).

Standard teaching hours/school year of preschool teachers = (standard teaching hours/day) x (number of working days/week) x (number of weeks teaching children/school year).

The salary for one teaching period of a teacher is determined as follows: salary for one extra teaching period - salary for one teaching period x 150%.

Overtime salary/school year = number of extra teaching hours/school year x salary for 1 extra teaching hour.

The funding source for paying overtime wages is arranged from the financial resources of public service units according to current regulations.
