"Legitimate" still owes taxes
According to statistics, by mid-2024, the entire tax industry had 20,724 electronic tax accounts using the eTax Mobile application; of which 3,302 accounts were linked to bank accounts (reaching 16%).
The total number of successful electronic tax payment transactions of households and individuals via the eTax Mobile application reached more than 23,834 transactions, with a total amount of up to 25.3 billion VND. It can be said that this is a step forward in tax management and payment, marking the Tax Department's transformation in promoting modernization and digital transformation.
eTax Mobile operates smoothly. There are no problems with tax declaration, payment or refund, then "unexpectedly" the Tax Department receives information from a taxpayer complaining that he has received a tax refund, but is reported to have a tax debt.
According to Vietnamnet on October 30, 2024, Ms. NTT (in Duy Xuyen) said that after completing tax settlement, she received a tax refund of 114,000 VND. However, when installing the eTax Mobile application, she saw a notice of debt of 114,000 VND.
Why is this happening? According to Mr. Nguyen Van Tiep - Director of Quang Nam Tax Department, when looking up data on the tax management system and verifying tax refund related documents sent to the tax authority, in 2022, taxpayers did not have any transactions related to tax declaration, tax payment, and tax refund at Quang Nam Tax Department.
“Ms. T. has two sources of income and must make a settlement herself with the tax authority, but she has authorized the main source of income to make the settlement. This leads to an excess amount of personal income tax payable from the income at the authorized settlement unit (this amount has been paid to Ms. T. by the authorized settlement unit). As for income from other sources, when the paying unit has not deducted the full 10% (extraordinary income of 120 million VND or less), there is still a shortage,” Mr. Tiep said.
Mr. Le Mai Khac Hung - Deputy Director of Quang Nam Tax Department said that according to regulations, Ms. T. has income from 2 places. If both places deduct 10% when paying income, she is authorized to settle the tax on her behalf. But only the main income place deducts 10%, so Ms. T. has to settle the tax herself.
However, Ms. T. did not settle the settlement herself but authorized the main income place to settle it. When settling, the authorized place only knew that the main income had enough obligations at the main income place, but the obligations at the income place that were lacking (not deducting 10%) were "legally and legally correct", Ms. T. still owed 114,000 VND in taxes.
According to Mr. Hung, handling this case is not difficult. Ms. T. must settle the matter herself. Adding up the income from the temporary place (because the main income place has been settled) will determine how much tax will arise.
“When the main income source authorized to settle the tax has deducted and returned to Ms. T., the tax authority did not pay or refund, so it is not correct to say that the tax authority did not offset the overpayment but refunded the money to Ms. T. If she wants to erase this tax debt, Ms. T. must settle it herself with the tax authority,” said Mr. Hung.
Mutual cooperation is needed
Mr. Nguyen Van Tiep - Director of Quang Nam Tax Department said that the tax industry has deployed the eTax Mobile application by regularly promoting its benefits and providing instructions on how to use it to taxpayers through the tax industry website and mass media.
This agency has opened many training courses, assigned civil servants to support taxpayers in installation and user instructions. Not only does it strengthen tax management, but it also contributes to building a transparent and friendly digital society, reducing time, costs and limiting risks for households and individuals.
Not only eTax Mobile, Quang Nam tax authority is always ready, interested in supporting, guiding taxpayers to declare, settle personal income tax and make timely personal income tax refunds.
Conferences to support personal income tax settlement directly and online have been held annually. The tax authority has assigned tax officials to conduct "Tax settlement support week" via phone, summarizing personal income tax policies on the tax authority's website for taxpayers to know and implement.
According to the Tax Department, using eTax Mobile will bring many benefits. Taxpayers can conduct electronic transactions with tax authorities anytime, anywhere, at any location with internet connection.
Without having to go directly to the treasury or bank, taxpayers can still complete their tax obligations quickly and accurately, minimizing administrative procedures, saving costs and travel time.
ETax Mobile also helps taxpayers easily manage, track, look up tax notifications, compare tax payment transactions to the state budget, and tax payment information is guaranteed to be safe and secure.
In addition, it is possible to change information, pay taxes electronically through connection, online integration with the commercial banking system, look up tax declaration records, tax settlement, taxpayer information, dependent information and some other utilities for taxpayers.
However, the efforts of the tax sector alone are not enough. Implementing the eTax Mobile application well as declaring, paying and settling personal income tax in a timely and correct manner also requires the cooperation of taxpayers.
It is important that taxpayers are truly aware of their rights and obligations through access to policies, information and guidance from the tax industry. Ms. NTT's case is a typical example.
Mr. Nguyen Van Tiep - Director of Quang Nam Tax Department said, eTax Mobile will summarize all sources of income in the year. When querying the "Look up settlement information" function on eTax Mobile, it will support calculating the remaining or surplus difference so that taxpayers can know the information and make their own personal income tax settlement with the tax authority.
The Tax Department has directed civil servants to proactively contact and continue to guide Ms. T. on how to perform operations on eTax Mobile, as well as some personal income tax policies so that Ms. T. can properly comply with personal income tax regulations and proficiently use this application.
