Lifting the suspension of asset transactions of 4 companies related to Phan Van Anh Vu

On May 22, the Office of the Ho Chi Minh City People's Committee issued Official Dispatch No. 4875/VP-NCPC to the Director of the Department of Natural Resources and Environment (TN-MT), Director of the Department of Justice, announcing that the City People's Committee had received Official Dispatch No. 2031/C01-P4 dated May 9, 2023 from the Office of the Ministry of Public Security's Investigation Police Agency on the cancellation of the temporary suspension of asset transactions, ensuring the normal operation of companies related to Phan Van Anh Vu.

Regarding this issue, Chairman of the Ho Chi Minh City People's Committee Phan Van Mai directed: Assign the Department of Natural Resources and Environment and the Department of Justice to coordinate in implementing the contents of Official Dispatch 2031/C01-P4 dated May 9, 2023 of the Office of the Ministry of Public Security's Investigation Police Agency on canceling the suspension of asset transactions, ensuring normal operations of companies related to Phan Van Anh Vu; report the implementation results to the Ho Chi Minh City People's Committee.

The implementation time is 15 days from the date of receipt of this document.

Lifting the suspension of asset transactions of 4 companies related to Phan Van Anh Vu - 1 — Land lot 15 Thi Sach (Ben Nghe ward, district 1, HCMC).

Previously, on May 9, the Office of the Ministry of Public Security's Investigation Police Agency (C01) sent Official Dispatch No. 2031/C01-P4 to the People's Committee of Ho Chi Minh City. Accordingly, on April 4, 2023, C01 received a request from Construction Joint Stock Company 79; Bac Nam 79 Construction Joint Stock Company; IVC Company Limited; Nhat Gia Phuc Joint Stock Company, requesting to cancel the suspension of asset transactions and freeze bank accounts to ensure normal operations of businesses in Ho Chi Minh City.

C01 has the following opinion: The Ministry of Public Security's Investigation Police Agency is handling the investigation of the cases of "Intentionally revealing state secrets", "Tax evasion", "Violating regulations on management and use of state assets causing loss and waste" and "Violating regulations on land management", related to Phan Van Anh Vu that occurred in Da Nang City.

To serve the investigation requirements of the above cases, ensure the recovery of state assets and execution of judgments, the Ministry of Public Security's Investigation Police Agency has seized assets in Ho Chi Minh City. The seized assets include the land use rights of the land plot at 15 Thi Sach, Ben Nghe Ward, District 1, of Bac Nam 79 Construction Joint Stock Company; land use rights, house ownership rights and other assets attached to the land at 8 Nguyen Trung Truc, Ben Thanh Ward, District 1.

In addition, on April 20, 2018, the Ministry of Public Security's Investigation Police Agency issued Official Dispatch No. 1230/CSDT (C44-P4) requesting the Ho Chi Minh City People's Committee to temporarily suspend transactions on assets (including shares, stocks, real estate, property rights) of individuals and organizations related to Phan Van Anh Vu (including Construction Joint Stock Company 79, Construction Joint Stock Company Bac Nam 79).

To date, all cases related to Phan Van Anh Vu have been brought to trial and the verdicts have come into legal effect. The verdicts only declare to continue maintaining the Order of seizure of the two assets, namely land use rights, house ownership rights and other assets attached to the above-mentioned land, but do not declare to suspend asset transactions or freeze the bank accounts of the companies to serve the execution of the verdict.

Therefore, C01 requests the Ho Chi Minh City People's Committee to direct relevant departments, branches and units, based on their assigned functions and tasks, to resolve the requests of companies related to Phan Van Anh Vu in accordance with the law, to ensure the legitimate rights and interests of shareholders and the normal operation of the enterprise.

Previously, C01 also sent a document to the People's Committee of Da Nang City requesting to lift the "freeze" of a series of assets and real estate related to Phan Van Anh Vu and related companies.

Immediately afterwards, the Chairman of the People's Committee of Da Nang City also issued a document directing relevant departments and branches to implement the request of C01.
