
Proposal to reduce the maximum number of People's Jurors in provincial courts and increase them in regional courts
Briefly presenting the Report on the draft Resolution promulgating the Regulations on organization and operation of the Jury, Vice Chairman of the Central Committee of the Vietnam Fatherland Front Hoang Quoc Thuy said that the draft Resolution amends and supplements 19/22 articles of the Regulations attached to Resolution 1213/2016/UBTVQH13 on the Regulations on organization and operation of the Jury, focusing on the basic contents on the organization and operation of the Jury.

Regarding the content of the draft Resolution, the Vice Chairman of the Central Committee of the Vietnam Fatherland Front stated that Article 1 of the draft Regulation stipulates that the Jury is a form of self-governing organization of the Juries and on the basis of new regulations on the organization of the People's Court in the Law on Organization of the People's Court in 2024 (amended and supplemented in 2025).
The People's Jury includes the People's Jury of provinces and cities (called provincial level), the People's Jury of regions and the People's Jury of military regions and equivalent (called military region level).

To ensure that there are enough People's Assessors to meet the requirements for participating in trials at both the Provincial People's Court and the Regional People's Court, the draft Resolution adjusts the maximum number of elected People's Assessors at the Provincial People's Assessor Group and the Regional People's Assessor Group. Accordingly, the draft Regulation stipulates that the Provincial People's Assessor Group maintains a minimum number of 20 people (as currently regulated), but adjusts the maximum number of People's Assessors from 100 people to 50 people, with Hanoi and Ho Chi Minh City not exceeding 70 people.
For the Regional Jury, the draft Regulations are adjusted in the direction of doubling the minimum and maximum number of Juries, accordingly the total minimum number of Juries is not less than 30 people (increased from 15 to 30 people) and the maximum is not more than 100 people (increased from 50 to 100 people).
Review carefully to avoid additional processes and procedures.
Briefing the Report on the Review of the Project Resolution on promulgating the Regulations on the Organization and Operation of the Jury, Chairman of the Committee on Law and Justice Hoang Thanh Tung said that the Committee agreed with the necessity of developing a Resolution on promulgating the Regulations on the Organization and Operation of the Jury for the reasons stated in Submission No. 34/TTr-MTTW-BTT of the Standing Committee of the Central Committee of the Vietnam Fatherland Front.
Regarding the preparation of the draft Resolution dossier, the Chairman of the Law and Justice Committee noted that although it was prepared according to a shortened order and procedure, the drafting agency had consulted the Government, the Supreme People's Court, the Ministry of National Defense, the Ministry of Finance and had a Report on receiving and explaining the comments to revise and complete the draft Resolution and Regulations.

The Committee on Law and Justice agreed with the content of the draft Regulation, which includes determining the number of assessors in each panel of assessors based on the number of judges allocated to each court, and at the same time stipulating the minimum/maximum number of assessors in each panel of assessors in each provincial and regional People's Court. This regulation closely follows the provisions of the Law on Organization of People's Courts on the jurisdiction of regional People's Courts, the number of judges and the practice of accepting and resolving cases and matters of each court.
Regarding the procedure for electing and recognizing the results of the election of the Head and Deputy Head of the People's Jury (Article 6), the Committee agrees with the provisions of the draft Regulations, and at the same time proposes not to add the provision "Based on the actual situation in the locality, the Standing Committee of the Provincial People's Council shall coordinate with the Chief Justice of the People's Court and the Standing Committee of the Vietnam Fatherland Front Committee at the same level to guide the organization of the Plenary Conference of the People's Jury to elect the Heads and Deputy Heads of the People's Jury of the region" at Point a, Clause 3, to avoid additional processes and procedures.
In his concluding remarks, Vice Chairman of the National Assembly Nguyen Khac Dinh highly appreciated the proactiveness of the drafting and reviewing agencies. The relevant agencies also closely coordinated in the process of drafting, reviewing, receiving, revising and perfecting the draft resolution and accompanying regulations.

The Vice Chairman of the National Assembly also suggested that after the National Assembly Standing Committee votes to approve the Resolution promulgating the Regulations on the organization and operation of the Jury, the Standing Committee of the Law and Justice Committee should coordinate with the Standing Committee of the Central Committee of the Vietnam Fatherland Front to complete the procedures to submit the Resolution to the Chairman of the National Assembly for signing and promulgation this week.
