Perhaps Mr. Kim never expected that after raising his children and grandchildren his whole life, he would end up being kicked out of the house by his own son and grandson, and could only move out with his wife to a hotel.


Transfer of property to nephew in advance

Mr. Kim, 86 years old, worked in colleges and universities in the past. In the 1990s, the school gave him a house in the Pudong New District, where he and his wife have lived ever since.

A few years ago, Mr. Kim fell ill and had to be hospitalized and had surgery, his health condition deteriorated rapidly. Since then, his son and daughter-in-law have been trying to persuade the old man to transfer the only property in his name to his grandson as soon as possible to avoid future problems.

Just like that, Mr. Kim transferred the house to his nephew, although the transfer contract stated the amount of 1.05 million yuan (equivalent to 3.6 billion VND), but in reality they did not pay him and his wife a penny. The two sides agreed that the property ownership belonged to the nephew, while the right to use it belonged to the grandparents. The grandparents could continue to live in the house.

But what happened next made Mr. Kim regret and blame himself for his decision even more.

Evicted from his own home

After the property was transferred, the nephew’s family, to show their “sincerity”, gave the newly issued property certificate to the old couple for safekeeping. Later, Mr. Kim rented out one floor to have more money to cover living expenses.

But starting last year, Mr. Kim's son suddenly expressed his desire to sell the house and buy a villa. Mr. Kim was extremely confused: If he sold the house, what would he and his wife do?

Despite the old couple’s pleas, the son remained indifferent and even spoke harshly to them. Later, because the couple refused to hand over the real estate certificate, the nephew went to the government agency to request a new real estate certificate on the grounds that it had been lost.

The old couple had to swallow their pride and fall into a situation where they had nowhere to go.

The house was also transferred to the nephew, but unexpectedly the son's family did not ignore the rent.

Mr. Kim said that in the second half of last year, his son's family went to the tenant, claiming that this was their house and demanding that they stop paying rent to Mr. Kim. Because the tenant and he and his wife had known each other for many years, and because they could not stand the selfish and arbitrary behavior of his son's family, they returned the house to Mr. and Mrs. Kim, then terminated the lease at the end of last year.

But just two days after the tenant moved out, Mr. Kim and his wife discovered that the lock on their door had been changed. “They changed the lock and locked us two old people out, not letting us in.”

The old couple can only live in hotels now.

The two elderly people had no place to stay and had to stay temporarily in a hotel. Mrs. Kim sighed helplessly: “Living in a hotel, I cannot cook for myself, so I cannot take good care of my husband’s health.”

Mr. Kim burst into tears: “Our son’s wedding, the bridal chamber, and the wedding banquet, everything was taken care of by the two of us. After our grandson was born, we also paid for a nanny. They never had to do anything before, we gave them everything, and yet they didn’t have the slightest bit of gratitude.”

The old couple thought back, perhaps it was because they had spoiled their children and grandchildren too much.

Lawyer Tan Du Ban - senior partner of Shanghai Thien Phap Law Firm said what happened to Mr. Kim's family was not accidental.

In recent years, property disputes between children and grandchildren in the family have increased. Many elderly people have transferred property to their children or grandchildren, calling it a sale but actually giving it away.

However, after receiving the house, if the children do not take care of the elderly and do not fulfill their support obligations, it is very difficult for the elderly to protect their rights.

Tan Yu Bin reminded that the elderly must be very cautious when dealing with major property issues such as real estate, should maintain control of their assets, handle important decisions cautiously, and not give up their property rights too early.

Seniors may choose other ways to pass on their assets. For example, you can provide for the inheritance of real estate in your will, or set up a family trust to manage your assets.

This not only ensures that the elderly have control over their assets, but also avoids premature transfer of assets to others and minimizes asset risks.
