On the morning of September 26, continuing the 49th session, the National Assembly Standing Committee gave opinions on the drafting of a joint resolution of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front guiding the process of consultation and introduction of candidates for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term.
According to the report, in the recent past, the Constitution has been amended and supplemented with a number of articles in Resolution No. 203/2025/QH15 and laws on the organization of the State apparatus have been amended, supplemented and newly issued to implement the policy of arranging and streamlining the apparatus in the political system, organizing local governments at two levels including provincial and communal levels.
The amended and supplemented Law on Election of Deputies to the National Assembly and People's Councils has adjusted the time for conducting consultations to introduce candidates for National Assembly deputies and People's Council deputies at all levels...
These regulations have had impacts and influences on the regulations on time, roadmap and responsibility for organizing consultations in Joint Resolution No. 09/2021/NQLT/UBTVQH14-CP-DCTUBTWMTQVN.
In addition, through summarizing the work of the Front participating in the election and supervising the election in 2021 and feedback from provinces and cities, it shows that a number of detailed regulations and instructions in Joint Resolution No. 09 are no longer suitable to reality and need to be reviewed and amended to meet the requirements of the election of deputies to the 16th National Assembly and People's Council deputies at all levels for the 2026-2031 term.
The amendment of the Joint Resolution aims to ensure the unity and synchronization of the system of legal documents on elections; ensure detailed regulations and specific instructions, facilitating the implementation of the organization of consultation and introduction of candidates for the 16th National Assembly and People's Councils at all levels for the 2026-2031 term, ensuring conformity with the organizational model after the restructuring and streamlining, contributing to promoting democracy and improving the quality of National Assembly deputies and People's Council deputies for the new term.

Presenting the Verification Report, Chairman of the National Assembly Delegation Affairs Committee Nguyen Thanh Hai said that the Committee agreed with the necessity of issuing a Resolution to create a complete and timely legal basis for organizing the election of deputies to the 16th National Assembly and People's Councils at all levels for the 2026-2031 term.
The Resolution plays an important role in concretizing the provisions of the Law on Election of Deputies to the National Assembly and People's Councils (amended in 2025), ensuring the unified and synchronous implementation process of the election work, overcoming legal gaps as well as limitations from the practices of previous terms.
The National Assembly Deputies' Affairs Committee believes that the timelines in the consultation and candidate nomination process stipulated in the draft resolution are consistent with the timelines stipulated in Resolution No. 199/2025/QH15 of the National Assembly on shortening the term of the 15th National Assembly and People's Councils at all levels for the 2021-2026 term; Election date for deputies to the 16th National Assembly and People's Councils at all levels for the 2026-2031 term and the consultation steps stipulated in the Law on Election, which has been amended and supplemented by a number of articles in Law No. 83/2025/QH15.
The Delegation Work Committee agreed with the timelines for conducting consultations and introducing candidates for National Assembly deputies and People's Council deputies in the draft Resolution.
In the case of a candidate who does not gain the trust of more than 50% of the total number of voters at the place of residence, Clause 1, Article 26 and Clause 1, Article 28 of the draft Resolution stipulate: "In cases where a candidate does not gain the trust of more than 50% of the total number of voters attending the conference of voters at the place of residence, he/she will not be included in the list of candidates for recommendation at the third consultative conference, except in special cases that need to be clearly reported for the consultative conference to consider and decide."
Regarding this issue, the Delegation Working Committee finds that this regulation has inherited Joint Resolution No. 09, however, to ensure convenience in application, it is necessary to clearly define the authority to consider the above special cases.
The Delegation Work Committee proposes to regulate in the following direction: At the central level, the authority belongs to the Standing Committee of the Central Committee of the Vietnam Fatherland Front . At the local level, the authority belongs to the leadership of the Fatherland Front Committee at the same level as the agency directly organizing the consultation conference.
“Such a regulation will ensure a unified legal basis and limit arbitrary application to special cases where there is not enough trust of over 50% as prescribed,” the review report emphasized.

Regarding the application of information technology, the Delegation Affairs Committee believes that in the context of the national digital transformation taking place strongly in all fields, Plan No. 56/KH/BCĐ dated July 4, 2025 of the Central Steering Committee on the application of information technology and digital transformation, the Delegation Affairs Committee proposes to add to the Resolution the regulations on the application of information technology in a number of contents in the nomination process in the direction of: "Encouraging and allowing the declaration and submission of candidates' dossiers, sending minutes of consultation conferences electronically through secure online platforms prescribed by the National Election Council," to enhance publicity, transparency, save time, resources, ensure the ability to deploy in cases of force majeure, especially in remote areas, islands, and communes with large areas.
At the same time, to meet the progress requirements according to the timelines stated in the Draft Resolution, the Delegation Work Committee proposed to allow the organization of consultation conferences combining in-person and online forms for provinces with large areas and many communes, thereby ensuring efficiency, timeliness and synchronization in the entire consultation process between levels.
Also at the meeting, the National Assembly Standing Committee considered and approved the Resolution of the National Assembly Standing Committee regulating the organization of voters' conferences; the introduction of candidates for People's Council deputies at the commune level in villages and residential groups; the consultation, introduction of candidates, and the preparation of lists of candidates for National Assembly deputies and People's Council deputies in by-elections (instructions for Clause 5, Article 45, Clause 4, Article 52, Clause 2, Article 92 of the Law on Election of National Assembly Deputies and People's Council Deputies).
The National Assembly Standing Committee considered the draft Joint Resolution amending and supplementing Joint Resolution No. 72/2025/NQLT/UBTVQH15-CP-DCTUBTWMTQVN dated February 20, 2025 of the National Assembly Standing Committee, the Government and the Presidium of the Central Committee of the Vietnam Fatherland Front detailing the contact with voters of National Assembly deputies and People's Council deputies at all levels.
The National Assembly Standing Committee considers and approves the Resolution promulgating the Model Working Regulations of the People's Councils of provinces and cities; the Resolution promulgating the Model Working Regulations of the People's Councils of communes, wards and special zones./.
