Decree 170/2025/ND-CP on recruitment, use and management of civil servants stipulates the abolition of relevant contents on commune-level civil servants in Decree No. 33/2023/ND-CP of the Government (regulations on commune-level cadres, civil servants and non-professional workers at commune level, in villages and residential groups).
The Law on Cadres and Civil Servants has linked communal-level cadres and civil servants with provincial-level cadres and civil servants, unifying a civil service regime from the central to communal level to implement the policy of building a unified, interconnected, and synchronous civil service from the central to communal level, without distinguishing communal-level cadres and civil servants with provincial-level cadres and civil servants.
Regulations on transition of commune-level cadres and civil servants according to regulations are converted into cadres and civil servants according to new regulations of the Law on Cadres and Civil Servants if they meet the standards and conditions on training level without requirements on working time, standards and conditions of civil servant ranks.
Resolution No. 76/2025/UBTVQH15 of the National Assembly Standing Committee on administrative unit arrangement stipulates: “Maintain the current salary regime, policies and position allowances (if any) of cadres, civil servants and public employees affected by the administrative unit arrangement but still cadres, civil servants and public employees at agencies and organizations in the political system for a period of 6 months from the date of the work arrangement document. After this period, implement the regime, policies and position allowances according to the provisions of law”.

Specifically, according to Decree 33, commune-level cadres and civil servants who have graduated from training according to the prescribed standards on professional qualifications and skills are entitled to the same salary as administrative civil servants with the same training level as prescribed in the professional salary table for cadres and civil servants in state agencies issued together with the Government's Decree on salary regime for cadres, civil servants, public employees and armed forces.
Graduation diplomas and training levels are issued according to regulations of the Ministry of Education and Training and of competent agencies and organizations that issue diplomas.
In case during the working period, commune-level cadres and civil servants have changes in training level suitable to the current position or title, they can request the Chairman of the District People's Committee to arrange salary according to the new training level from the date of graduation certificate issuance.
In case a person is elected as a commune-level cadre, recruited and accepted to work as a commune-level civil servant according to the provisions of this Decree and has had a working period with compulsory social insurance payment but has not received a one-time social insurance allowance, the working period with compulsory social insurance payment will be calculated as the basis for salary classification (excluding the probationary period), the working period with non-continuous compulsory social insurance payment will be accumulated.
Thus, Decree 170/2025/ND-CP stipulates the abolition of relevant regulations on commune-level civil servants in Decree 33/2023/ND-CP, including the abolition of regulations on salaries.
